An Ordinance approving Change Order No. 2 to the Agreement for the construction of the Water Main Replacement FY22 - First Phase Project, Project No. 496-1, between the City of Lee's Summit, Missouri, and Wiedenmann, Inc., for an increase in the contract price of $197,938.00 for a revised agreement amount of $4,022,415.75 and to increase the project timeline by 40 calendar days, and authorizing the City Manager to execute the same.
Key Issues:
• Pursuant to Ordinance No. 9390, the City and Wiedenmann, Inc., (hereinafter "Contractor") entered into an Agreement for the construction of the Water Main Replacement: FY22 Project, Project No. 496-1, (hereinafter "Base Agreement").
• The City and Contractor modified the Base Agreement, as amended, per Change Order No. 1 to provide straddle blocks and additional/amended DI fittings, to correct the size of a proposed tee fitting and to document material substitutions.
• The City desires to further modify the Base Agreement, as amended, to include work as part of the Water Main Replacement FY22 - Phase 2 Project, (hereinafter "Future Project"). City Staff determined the work originally slated for the Future Project is better suited to be included as part of the Base Agreement. The work as prescribed for the Future Project is referenced in the Future Project project's plans on sheet 6 (hereinafter "Change Order No. 2")
• The work included in Change Order No.2, includes mobilization, demolition and removal, water main replacement, water main abandonment, new water service line, water service reconnects, new meter well, new 6” and 8” gate valves, new fire hydrants, pavement repair, curb and gutter replacements, sidewalk replacements, restoration, erosion control and traffic control.
• Pay items included as part of Change Order No. 2 shall meet the requirements of Section 01120 Measurement and Payment included in Water Main Replacement FY22 - Phase 1 Project.
Proposed City Council Motion:
FIRST MOTION: I move to recommend to City Council approval of an Ordinance approving Change Order No. 2 to the Agreement with Wiedenmann, Inc., for the for the construction of the Water Main Replacement FY22 - First Phase Project, Project No. 496-1, for an increase of $197,938.00 for a revised agreement amount of $4,022,415.75 and to increase the project timeline by 40 calendar days, and authorizing the City Manager to execute the same.
SECOND MOTION: I move for the adoption of an Ordinance approving Change Order No. 2 to the Agreement with Wiedenmann, Inc., for the for the construction of the Water Main Replacement FY22 - First Phase Project, Project No. 496-1, for an increase of $197,938.00 for a revised agreement amount of $4,022,415.75 and to increase the project timeline by 40 calendar days, and authorizing the City Manager to execute the same.
Background:
This Change Order will adjust the contract price to perform the work. The overall project time will be extended by 40 calendar days and the overall cost will increase. Section 8.2.3 states that Change orders resulting in an increase to the contract time exceeding ten percent (10%) of the original contract time, a single change order increasing contract time by 30 days or more shall be approved by the appropriate Committee and City Council.
The contract time to account for the time required to perform the additional work as it effects the project's critical path timeline adding 40 calendar days as part of Change Order No. 2. This results in revise contract time of 340 calendar days.
As presented on Change Order #1, additional straddle blocks and additional/amended DI fittings, to correct the size of a proposed tee fitting and to document material substitutions.
Presented on Change Order #2, quantities of mobilization, demolition and removal, water main replacement, water main abandonment, new water service line, water service reconnects, new meter well, new 6” and 8” gate valves, new fire hydrants, pavement repair, curb and gutter replacements, sidewalk replacements, restoration, erosion control and traffic control are required to perform the additional work. Contract time overall will increase by 40 calendar days from 300 calendar days to 340 calendar days.
This change provides contract quantities and contract time to perform the additional work.
The increase in quantities increases the project by $197,938.00 for a revised Agreement amount of $4,022,415.75.
