Issue/Request:
An Ordinance approving Modification No. 3 to the agreement dated August 23, 2018 (RFQ No. 2018-064) between the City of Lee’s Summit, Missouri and HDR, Inc. for professional engineering services for Sanitary Sewer Modeling, Hydraulic Capacity and Design Services, for an increase of $25,200.00 with an amended not to exceed amount of $532,735.00, and authorizing the City Manager to enter into an agreement for the same.
Key Issues:
- Pursuant to Ordinance No. 8429 the City and HDR, Inc. (hereinafter “Engineer”) entered into an Agreement dated August 23, 2018 (RFQ No. 2018-064) for professional engineering services for Sanitary Sewer Modeling, Hydraulic Capacity and Design Services (hereinafter “Base Agreement”)
- Pursuant to Ordinance No. 8794 the City and the Engineer entered into Modification No. 1 to the Agreement on December 30, 2019 for final design services for improvements to the downtown interceptor, now called the McClendon Ditch Sewer Improvements.
- Pursuant to Ordinance No. 9370 the City and the Engineer entered into Modification No. 2 to the Agreement on March 31, 2022 for additional water main replacement design services for improvements to the downtown interceptor, now called the McClendon Ditch Sewer Improvements.
- The City and Engineer desire to further amend the provisions of the Base Agreement and previous modifications to cover additional engineering efforts and costs related to construction time extensions.

I move to recommend to City Council approval of an Ordinance approving Modification No. 3 to the agreement dated August 23, 2018 (RFQ No. 2018-064) between the City of Lee’s Summit, Missouri and HDR, Inc. for professional engineering services for Sanitary Sewer Modeling, Hydraulic Capacity and Design Services, for an increase of $25,200.00 with an amended not to exceed amount of $532,735.00, and authorizing the City Manager to enter into an agreement for the same.

FIRST MOTION: I move for second reading of an Ordinance approving Modification No. 3 to the agreement dated August 23, 2018 (RFQ No. 2018-064) between the City of Lee’s Summit, Missouri and HDR, Inc. for professional engineering services for Sanitary Sewer Modeling, Hydraulic Capacity and Design Services, for an increase of $25,200.00 with an amended not to exceed amount of $532,735.00, and authorizing the City Manager to enter into an agreement for the same.
SECOND MOTION: I move adoption of an Ordinance approving Modification No. 3 to the agreement dated August 23, 2018 (RFQ No. 2018-064) between the City of Lee’s Summit, Missouri and HDR, Inc. for professional engineering services for Sanitary Sewer Modeling, Hydraulic Capacity and Design Services, for an increase of $25,200.00 with an amended not to exceed amount of $532,735.00, and authorizing the City Manager to enter into an agreement for the same.
Background:
The City contracted HDR, Inc. to evaluate the trunk sewer from downtown to the Cedar Creek Interceptor. The downtown interceptor was previously identified for upgrades that would reduce inflow and infiltration, improve system reliability, and increase capacity for densification of the downtown basin served by the interceptor.
Modification No. 1 to the Base Agreement was for final design services for the improvements to the downtown interceptor, a.k.a. McClendon Ditch Sewer Improvements. Modification No. 2 added the design of the replacement of the existing 6'' water main along McClendon Drive to minimize construction impacts to local residents.
The original project schedule for HDR's engineering services anticipated the majority of construction to occur in 2021. Due to prolonged easement acquisitions, the re-bid of the project after a six month pause, and unanticipated constructions delays the project is now anticipated to be completed spring/summer of 2024. Modification No. 3 will extend the contract duration to compensate for these additional engineering efforts and costs related to construction time extensions.
Impact/Analysis:
This modification will allow HDR, Inc to assist the City through the rest of the anticipated construction duration of the McClendon Ditch Sewer Improvements project. Additional efforts will include submittal reviews, progress meetings, site visits and assisting with project completion activities.
