Issue/Request:

An Ordinance approving Modification No. 2 to an Agreement dated August 15, 2019 (RFQ No. 543-32272D) for Professional Engineering Services for Stormwater Improvements - 5 locations by and between the City of Lee's Summit, Missouri, and Burns & McDonnell Engineering Company, Inc. for an increase of $39,930.00 with a not to exceed amount of $246,540.00, and authorizing the City Manager to execute an agreement for the same.

  • Stormwater infrastructure improvements were approved by City Council in the FY2019 Capital Improvement Plan
  • These projects are funded by the Stormwater Bond Issue approved by voters in 2007.

Proposed City Council Motion:

FIRST MOTION: I move for a second reading of an Ordinance authorizing the execution of Modification No. 2 to an Agreement dated August 15, 2019 (RFQ No. 543-32272D) for Professional Engineering Services for Stormwater Improvements - 5 locations by and between the City of Lee's Summit, Missouri, and Burns & McDonnell Engineering Company, Inc. for an increase of $39,930.00 with a not to exceed amount of $246,540.00, and authorizing the City Manager to execute an agreement for the same.

SECOND MOTION: I move for adoption of an Ordinance authorizing the execution of Modification No. 2 to an Agreement dated August 15, 2019 (RFQ No. 543-32272D) for Professional Engineering Services for Stormwater Improvements - 5 locations by and between the City of Lee's Summit, Missouri, and Burns & McDonnell Engineering Company, Inc. for an increase of $39,930.00 with a not to exceed amount of $246,540.00, and authorizing the City Manager to execute an agreement for the same.

 

 

Background:

Following the qualification based selection process, Burns & McDonnell Engineering was selected to perform the professional engineering services for Stormwater Improvements - 5 Locations project.  An agreement between the City and Burns & McDonnell Engineering was executed on August 15, 2019 for professional engineering services to design the Stormwater Improvements - 5 Locations.   Burns and McDonnell Engineering has provided the City with the Scope of Basic Services outlined in the original agreement.

 

The City has advertised and awarded the construction of Stormwater Improvements - 5 Locations to Leath & Sons.  Engineering support during construction from the engineer of record is part of the current standards of practice to ensure the project is completed as intended.  Typically, construction services are not included in the original design contract because the design, proposed construction, and schedule will change through the design process.  Waiting until after the final plans are complete allows the construction services scope to be modeled on the actual work to be completed.

 

The Contractor will be required to submit shop drawings from fabricators, materials certifications from suppliers that must be reviewed by Burns & McDonnell Engineering to ensure conformance with the project’s plans and specifications.   Other engineering support during construction will include plan revisions as needed based on actual conditions in the field, reviewing change orders, answering questions related to the project design, attending periodic construction progress meetings, and prepare post-construction record drawings for City records.

 

 

Impact/Analysis:

This modification will allow Burns & McDonnell Engineering to provide the City with Submittal Review of the items identified in the background paragraph.  Not having appropriate engineering services during construction does not follow current standards of practice for engineering and construction quality assurance.

 

Timeline:

Construction for this project is scheduled to begin October 2020.

The Public Works Committee voted 3-0 (Councilmember Shields recused herself from voting), to recommend to City Council approval of an Ordinance authorizing the execution of Modification No. 2 to an Agreement dated August 15, 2019 (RFQ No. 543-32272D) for Professional Engineering Services for Stormwater Improvements - 5 locations by and between the City of Lee's Summit, Missouri, and Burns & McDonnell Engineering Company, Inc. for an increase of $39,930.00 with a not to exceed amount of $246,540.00, and authorizing the City Manager to execute an agreement for the same.
