Issue/Request:

An ordinance authorizing the execution of Modification No. 1 to agreement dated February 24, 2017 for Commerce Drive Improvements (RFQ No. 2017-305B) by and between the City of Lee’s Summit, Missouri and Walter P. Moore, Inc., for a revised contract amount not to exceed $148,110.00.

Key Issues:

 

The Commerce Drive Improvements Project was approved by City Council in the FY2017 Capital Improvement Plan and it is funded by savings from the 2007 CIP Sales Tax Renewal.

 

 The City desires to modify the base agreement with Walter P. Moore to provide additional engineering services during construction.  These services will include reviewing shop drawings, material submittals, periodic construction site visits, answering questions related to the design of the project, and preparing post-construction record drawings.  The City also desires to exercise Optional Service No. 1, NW Commerce Sidewalk Extension.  This would enable Walter P. Moore to develop plans to fill in a sidewalk gap along Commerce Drive between Chipman Road and Main Street.  Optional Service No. 2, Property Appraisal and Acquisition, will not be performed by the Engineer, so that work can be removed from the scope of services. 

 

The base contract with Walter P. Moore was approved by Council on February 9, 2017 for $150,110.  This Modification will yield a net decrease of $2,000 by adding construction phase services to the scope of work and not using some of the optional services in the base agreement.  Construction for this project is scheduled to begin in November, 2018.

 

 

Proposed City Council Motion:

I move for adoption of an Ordinance authorizing the execution of Modification No. 1 to agreement dated February 24, 2017 for Commerce Drive Improvements (RFQ No. 2017-305B) by and between the City of Lee’s Summit, Missouri and Walter P. Moore, Inc., for a revised contract amount not to exceed $148,110.00

Background:

An agreement between the City and Walter P. Moore was executed on February 24, 2017 for professional engineering services to design the Commerce Drive project.   Walter P. Moore completed the design with basic scope of services outlined in the original agreement, except for some of pre-construction services still underway. 

 

The City has advertised and awarded the construction of Commerce Drive to Lexeco.  The Contractor will be required to submit shop drawings from fabricators, materials certifications from suppliers that must be reviewed by Walter P. Moore Engineers to ensure conformance with the project’s plans and specifications.   Other engineering support during construction will include plan revisions as needed based on actual conditions in the field, reviewing change orders, answering questions related to the project design, attending periodic construction progress meetings, and prepare post-construction record drawings for City records.

 

The original contract authorized a fee up to $150,110 that was split between basic services and optional services.  The basic services were those necessary to complete the work for a not to exceed amount of $111,800.  The optional services allowed for contingencies to extend sidewalk along existing Commerce Drive.  The $14,160 for Property Appraisal and Acquisition of optional services were not required, and are being deleted from the contract in this modification. The additional services included in modification No. 1 are for a not to exceed amount of $12,160.  Therefore, there will be a net decrease of $2,000 for a revised contract total of $148,110. 

 

Impact/Analysis:

This agreement will allow Walter P. Moore to provide the City with Submittal Review of the items identified in the background paragraph and to provide the contractor with plans for a sidewalk extension.  Not having appropriate engineering services during construction does not follow current standards of practice for engineering and construction quality assurance.
