Issue/Request:
Approval of a funding agreement between Pinetree Homeowners Association, Inc., and the City of Lee's Summit, Missouri for the Pinetree storm sewer development.

Key Issues:

· The Pine Tree stormwater improvement project is scheduled to begin construction this summer.
· The Pinetree Village HOA assessed all residents in order to pay for design of an extension of the project into the subdivision as well as for a portion of the construction.
· This agreement addresses the process for the transfer of funds from the HOA to the City when construction is ready to begin.
Proposed City Council Motion:
I move for a second reading of an ordinance authorizing the execution of an agreement by and between the City of Lee's Summit and the Pinetree Village Homeowners Association which serves as the controlling association of properties within the Pinetree Village Subdivision for funding of the Pinetree Stormwater Improvement Project.

Background:
Several years ago, residents of the Pinetree Village subdivision approached then Councilmember Brian Whitley and City staff to discuss extending installation of a storm sewer system planned for an adjacent area through the subdivision. A project was planned along SE Mission Rd and through the Pine Tree Plaza commercial development to address residential flooding. Several areas in the Pine Tree subdivision have experienced erosion, ponding water, and possible foundation problems.
