An ordinance authorizing the execution of an agreement by and between the City of Lee's Summit and the Pinetree Village Homeowners Association which serves as the controlling association of properties within the Pinetree Village Subdivision for funding of the Pinetree Stormwater Improvement Project.  (PWC 7-17-18)

Issue/Request:

Approval of a funding agreement between Pinetree Homeowners Association, Inc., and the City of Lee's Summit, Missouri for the Pinetree storm sewer development.

 

Key Issues:

 

                     The Pine Tree stormwater improvement project is scheduled to begin construction this summer.

                     The Pinetree Village HOA assessed all residents in order to pay for design of an extension of the project into the subdivision as well as for a portion of the construction.

                     This agreement addresses the process for the transfer of funds from the HOA to the City when construction is ready to begin.

Proposed City Council Motion:

I move for a second reading of an ordinance authorizing the execution of an agreement by and between the City of Lee's Summit and the Pinetree Village Homeowners Association which serves as the controlling association of properties within the Pinetree Village Subdivision for funding of the Pinetree Stormwater Improvement Project.

 

Background:

Several years ago, residents of the Pinetree Village subdivision approached then Councilmember Brian Whitley and City staff to discuss extending installation of a storm sewer system planned for an adjacent area through the subdivision. A project was planned along SE Mission Rd and through the Pine Tree Plaza commercial development to address residential flooding. Several areas in the Pine Tree subdivision have experienced erosion, ponding water, and possible foundation problems. The HOA voted to assess all residents in order to help pay the cost of the system extension. Part of those funds were used to pay for the design of the extension through the subdivision. The remainder is intended to go toward the construction. The Council at the time agreed in concept, but the formal agreement was not processed. This agreement will finalize the conditions for the transfer of funds from the HOA for the construction project. The project is anticipated to be advertised in the next few weeks with construction most likely commencing in September. This project is the last project budgeted from the 2007 G.O. bonds for stormwater improvements.

 

Impact/Analysis:

The additional scope of work in the project will address several long-standing problems in the Pine Tree area with the cost being partially offset with funds from the HOA.

Start: Approx. July 2018

Finish: Spring 2019

 

Other Information/Unique Characteristics:

This is an unique partnership that was initiated by the residents and members of the HOA in order to help address drainage problems in the subdivision.
