 Issue/Request:

An Ordinance approving Change Order No. 1 to the Agreement for the construction of the Cathodic Protection Program: FY22 Project, Project No. 57831683-22, between the City of Lee's Summit, Missouri, and Dust Pipeline Services Inc. for an increase of $56,145.00 for a revised agreement amount of $504,214.00 and to increase the Project timeline by 21 calendar days, and authorizing the City Manager to execute the same.

 

Key Issues:

                     Pursuant to Ordinance No. 9369, the City and Dust Pipeline Services, Inc., (hereinafter “Contractor”) entered into an Agreement for construction of the Cathodic Protection Program: FY22 Project, Project No. 57831683-22, (hereinafter “Base Agreement”).

                     The City desires to modify the Base Agreement for an increased cost and timeline associated with the deep installation of anodes.  Due to the excessive depth of the existing water mains on the Project,  costs incurred and time expended to install anodes for these deep water mains was significant and unanticipated prior to the Project . (hereinafter “Change Order No. 1”).

 

Proposed City Council Motion:

FIRST MOTION:  I move for a second reading of an Ordinance approving Change Order No. 1 to the Agreement with Dust Pipeline Services Inc. for the Cathodic Protection Program FY22 Project, Project No. 57831683-22, for an increase of $56,145.00 for a revised agreement amount of $504,214.00 and to increase the project timeline by 21 calendar days, and authorizing the City Manager to execute the same.

SECOND MOTION:  I move for adoption of an Ordinance approving Change Order No. 1 to the Agreement with Dust Pipeline Services Inc. for the Cathodic Protection Program FY22 Project, Project No. 57831683-22, for an increase of $56,145.00 for a revised agreement amount of $504,214.00 and to increase the project timeline by 21 calendar days, and authorizing the City Manager to execute the same.

 

 

Background:

This Change Order addresses the following issue:

 

An increase in contract cost and contract time, due to the excessive depth of existing water mains on the Project, requiring larger and deeper excavations.

 

Delays in getting utilities located, and the poor level of accuracy of those locates, significantly affected construction productivity. A number of utility conflicts required the use of vacuum excavation, a method not reasonably anticipated for this project or presented in the Project documents.

 

Change site conditions required adjusting anode locations in the field to provide proper anode spacing, while avoiding tree damage, by cutting tree roots as well as damage to other surface improvements located adjacent to the planned location of anode installation. These impacts increased construction cost and delayed production.

 

Change Order #1 adds $56,145.00 for a revised agreement amount of $504,214.00 and to increase the project timeline by 21 calendar days.

 

As required by Section 8.2.3 of the Procurement Policy, change orders resulting in an increase to the contract time exceeding ten percent (10%) of the original contract time. This documents the increase in time due the contract.
