An Ordinance authorizing the execution of the Missouri Highways and Transportation Commission Cost Share Agreement Supplemental #1 between the City of Lee's Summit, Missouri, and the Missouri Highways and Transportation Commission for State Project Number J4P3196, M291 North Interchange with US50, and authorizing the Mayor to execute an agreement for the same.
Key Issues:
• Pursuant to Ordinance No. 9303, the City entered into a Cost Share Agreement, Agreement No.2021-03-61790 (hereinafter “Original Agreement”), with the Missouri Highways and Transportation Commission (hereinafter “MoDOT”) for the M291 North Interchange with Highway US 50 Project, Commission Project No. J4P3196, to improve the safety and overall functionality of this transportation corridor (hereinafter “Interchange Project”).
• Recent ROW submittals from Olsson, Inc. (hereinafter “Engineer”) included their Engineer’s construction estimate of $23.6M which is a $7.6M increase from the estimate in the Original Agreement.
• The Project was approved by MoDOT to receive $6.4 million of federal funding through the Federal Highway Administration's (hereinafter "FHWA") Surface Transportation Block Grant Program (hereinafter "STBG").
• This Cost Share Agreement Supplemental #1 (hereinafter “Supplemental”) between the City and MoDOT is necessary to update the estimated cost increase, financial responsibilities, and City secured STBG funding.
Proposed Committee Motion:
I move to recommend to City Council approval of an Ordinance authorizing the execution of the Missouri Highways and Transportation Commission Cost Share Agreement Supplemental #1 between the City of Lee's Summit, Missouri, and the Missouri Highways and Transportation Commission for State Project Number J4P3196, M291 North Interchange with US50, and authorizing the Mayor to execute an agreement for the same.
Background:
The Interchange Project will improve the safety and functionality of the overall transportation system in the area. The project will replace obsolete infrastructure to address traffic level of service, accommodate growth, and facilitate economic activity. Improvements to this area include a new bridge structure, ramp reconstruction, US 50 pavement reconstruction between the ramps, changing SE Oldham Parkway to a right-in-right-out configuration, and realignment of the intersection of Blue Parkway to the north at the existing location of SE 7th Terrace.
On January 10, 2022, MoDOT and the City entered into a Cost Share Agreement, Agreement No. 2021-03-61790, to improve the safety and overall functionality of this transportation corridor. The Original Agreement estimated the total cost of the Interchange Project to be $21.9M, which included a construction estimate of $16M. The Original Agreement shows the City’s cost share portion being approximately $9.9M (45%) and MoDOT’s portion being approximately $12M (55%). The Original Agreement also states that the City shall be responsible for the balance in excess of the estimated $21.9M. As part of the recent ROW submittals to the City and MoDOT, the Engineer submitted their Engineer’s construction cost estimate of $23.6M which is $7.6M greater than the $16M estimated in the Original Agreement. This increases the estimated total cost of the Interchange Project to $29.5M and the City’s portion to $17.5M.
On February 28, 2023, MoDOT notified the City of being awarded federal funding for the Interchange Project in the amount of $6.4M through the FHWA STBG program. This additional funding, secured by the City, reduces the City’s cost portion of the Interchange Project from $17.5M to $11.1M. The STBG funding is a reimbursement program available in federal fiscal year 2025 for construction costs.
MoDOT is responsible for construction management of the Interchange Project. This Supplemental includes the $6.4M STBG funding awarded to the City, and the City agrees that MoDOT may obligate the STBG funding, available in federal fiscal year 2025, for the construction cost of the Interchange Project. The construction cost increase, financial responsibilities, and funding for the Interchange Project are updated in this Supplemental.
