Issue/Request:
The applicant requests to vacate a 7.5’ wide x 70.94’ long portion of a 10’-wide general utility easement along the SW Trail Ridge Ln frontage (southeast boundary) of the subject site in order to eliminate a conflict between the easement and the location of a retaining wall. City policy prohibits the encroachment of certain structures, such as retaining walls, onto public easements. There are no utilities located within the subject portion of easement to be vacated.

I move for adoption of an Ordinance vacating a portion of a certain easement located at 1801 SW Fountain Drive in the City of Lee's Summit, Missouri.

Recommendation
Recommendation: With the condition of approval below, the application meets the requirements of the UDO and Design and Construction Manual (DCM).
1. The vacation of easement shall become effective immediately at the time of ordinance approval.
