Issue/Request:

An Ordinance approving Change Order No. 3 to the agreement with Sands Construction, LLC. for the Sidewalk Gap Program FY23 Project, Project No. 718, for an increase of $242,219.97 for a revised agreement amount of $2,292,211.20 and authorizing the City Manager to execute an agreement for the same.

 

 

Key Issues:

                     Pursuant to Ordinance No. 9586, the City of Lee's Summit, Missouri ("City") and Sands Construction, LLC. (hereinafter "Contractor") entered into an agreement for the construction of the Sidewalk Gap Program FY23 Project ("Project").

  •                       Pursuant to the change order administrative approval process prescribed in the City's Procurement Policy, the City and Contractor executed Change Order No. 1 to adjust the Project price.

•                       Pursuant to Ordinance No. 9799, the City and Contractor executed Change Order No. 2 to adjust construction time and price to allow for removal and replacement of driveways in multiple locations to maintain ADA compliance.

                     The City desires to further modify the Base Agreement, as amended, to adjust construction contract price to allow for removal and replacement of driveways beyond the Right-of-Way in multiple locations to complete the work.

 

Proposed Committee Motion:

I move to recommend to City Council approval of an Ordinance approving Change Order No. 3 to the agreement with Sands Construction, LLC. for the Sidewalk Gap Program FY23 Project, Project No. 718, for an increase of $242,219.97 for a revised agreement amount of $2,292,211.20 and authorizing the City Manager to execute an agreement for the same.

                     

Proposed City Council Motion:

FIRST MOTION: I move for second reading an Ordinance approving Change Order No. 3 to the agreement with Sands Construction, LLC. for the Sidewalk Gap Program FY23 Project, Project No. 718, for an increase of $242,219.97 for a revised agreement amount of $2,292,211.20 and authorizing the City Manager to execute an agreement for the same.

 

SECOND MOTION: I move for adoption of an Ordinance approving Change Order No. 3 to the agreement with Sands Construction, LLC. for the Sidewalk Gap Program FY23 Project, Project No. 718, for an increase of $242,219.97 for a revised agreement amount of $2,292,211.20 and authorizing the City Manager to execute an agreement for the same.

 

 

 

Background:

Change Order No. 1 addressed conflicts in the field and the Public Works staff determined the best course of action was to add the items as follows: Type B ADA ramps, stamped concrete, sidewalk with Integral curb, and 6" and 12" monolithic curb. The Change order was approved administratively per the City's Procurement Policy. 

 

Change Order No. 2 adjusted the contract time and price to reflect additional work required in order to complete the project. The overall project time will be extended by 113 days for a total of 233 days. The contractor had to work in different parts of area 3 while awaiting acquisition agreement letters. The additional time was needed due to the number of driveways where the second and third panel had to be removed to maintain ADA compliance. Adding the extra work significantly delayed the contractor, as well as overrunning driveway quantities.

 

This Change Order No. 3 is necessary for removal and replacement of driveways beyond the Right-of-Way in multiple locations for this project. The original design required modification in the field to adjust to actual site conditions.  Driveway approaches in various locations throughout the project required removal and replacement in excess of 10 feet from the back of curb.  The additional length removed allowed for further slope flattening to provide a traversable driveway entrance and provide for ADA compliance. Additional quantities of driveways, sidewalks, sidewalk with retaining wall and grading to provide for a smooth transition, among others, were required to complete the project.

 

Impact/Analysis:

This project is expected to close remnant gaps and will help to increase non-motorized mobility and safety within neighborhoods throughout the City.
