Issue/Request:

An Ordinance approving Modification No. 1 to an Agreement for Professional Engineering Services for the Olive and Orchard Road and Storm Sewer Improvements (Douglas Street to Chipman Road) Project (RFQ No. 2022-060) with Kimley-Horn and Associates, for an increase of $119,101.50 for the amended Basic Services, with an amended not to exceed amount of $974,529.50, and authorizing the City Manager to execute an agreement for the same. 

 

Key Issues:

                     The City and Kimley-Horn and Associates, (hereinafter "Engineer") entered into an Agreement for Professional Engineering Services for the Olive and Orchard Street and Storm Sewer Improvements (Douglas Street to Chipman Road) Project (RFQ No. 2022-060) dated November 21, 2022 (hereinafter "Base Agreement").

 

                     The City desires to modify the base agreement with Engineer to provide additional engineering services during design.

 

                     The Engineer has submitted a proposal with estimated costs to provide additional engineering services.

 

                     The City desires to modify the Base Agreement, as amended, with Engineer as provided herein (hereinafter "Modification No. 1").

 

Proposed Committee Motion:

I move to recommend to City Council approval of An Ordinance approving Modification No. 1 to an Agreement for Professional Engineering Services for the Olive and Orchard Street and Storm Sewer Improvements (Douglas Street to Chipman Road) Project (RFQ No. 2022-060) with Kimley-Horn and Associates, for an increase of $119,101.50 for the amended Basic Services, with an amended not to exceed amount of $974,529.50, and authorizing the City Manager to execute an agreement for the same. 

 

 

Proposed City Council Motion:

FIRST MOTION: I move for a second reading of an Ordinance approving Modification No. 1 to an Agreement for Professional Engineering Services for the Olive and Orchard Street and Storm Sewer Improvements (Douglas Street to Chipman Road) Project (RFQ No. 2022-060) with Kimley-Horn and Associates, for an increase of $119,101.50 for the amended Basic Services, with an amended not to exceed amount of $974,529.50, and authorizing the City Manager to execute an agreement for the same. 

 

SECOND MOTION: I move for adoption of an Ordinance approving Modification No. 1 to an Agreement for Professional Engineering Services for the Olive and Orchard Street and Storm Sewer Improvements (Douglas Street to Chipman Road) Project (RFQ No. 2022-060) with Kimley-Horn and Associates, for an increase of $119,101.50 for the amended Basic Services, with an amended not to exceed amount of $974,529.50, and authorizing the City Manager to execute an agreement for the same. 

 

 

Background:

Following a qualification-based selection process, Kimley-Horn and Associates was selected to perform the professional engineering services for the Olive and Orchard Road and Storm Sewer Improvements project. The Base Agreement between the City and Engineer was executed on November 21, 2022.

 

Modification No. 1 includes additional survey and design for storm sewer improvements along Forest Avenue that were determined to be necessary during preliminary design. Storm water from Douglas Road will be routed along Forest Avenue right-of-way to the proposed storm water basin at the end of Olive Street to avoid inundating residential yards.

 

Modification No. 1 also includes the design of a retaining wall needed for the proposed detention basin. The base agreement included design of the basin, however, after assessment of the required detention volume, it was determined that a retaining wall will be needed to maximize detention volume in the basin footprint.

 

Modification No. 1 also includes design to relocate the sanitary sewer main around the proposed detention basin. During basin design, it was determined that the sanitary sewer line located within the footprint of the proposed detention basin, is not deep enough for proper separation and will need to be relocated.

 

Modification No. 1 includes Phase 1 environmental services for the structures located on 315 NW Olive Street. This parcel will need to be purchased to construct the proposed detention basin and as is standard City practice for property purchase, a Phase 1 environmental review will need to be completed.
