Issue/Request:

An Ordinance approving Change Order No. 2 to the agreement with Sands Construction, LLC for the Sidewalk Gap Program FY23 Project, Project No. 718, for an increase of $219,880.73 for a revised agreement amount of $2,049,991.23 and to increase the project timeline by 113 days, and authorizing the City Manager to execute an agreement for the same.

 

 

Key Issues:

  Pursuant to Ordinance No. 9586, the City of Lee's Summit, Missouri ("City") and Sands construction, Inc. (hereinafter "Contractor") entered into an agreement for the construction of the Sidewalk Gap Program FY23 Project ("Project").

  Pursuant to the change order approval process prescribed in the City's Procurement Policy, the City and Conractor entered Change Order No. 1 to adjust the Project price.

•  The City desires to further modify the Base agreement, as amended, to adjust construction contract time to allow for removal and replacement of driveways in multiple location to maintain ADA compliance. 

Proposed Committee Motion:

I move to recommend to City Council approval of An Ordinance approving Change Order No. 2 to the agreement with Sands Construction, LLC for the Sidewalk Gap Program FY23 Project, Project No. 718, for an increase of

$219,880.73 for a revised agreement amount of $2,049,991.23 and to increase the project timeline by 113 days, and authorizing the City Manager to execute an agreement for the same.

                     

Proposed City Council Motion:

FIRST MOTION: I move for second reading an Ordinance approving Change Order No. 2 to the agreement with Sands Construction, LLC for the Sidewalk Gap Program FY23 Project, Project No. 718, for an increase of $219,880.73 for a revised agreement amount of $2,049,991.23 and to increase the project timeline by 113 days, and authorizing the City Manager to execute an agreement for the same.

 

SECOND MOTION: I move for adoption of an Ordinance approving Change Order No. 2 to the agreement with Sands Construction, LLC for the Sidewalk Gap Program FY23 Project, Project No. 718, for an increase of $219,880.73 for a revised agreement amount of $2,049,991.23 and to increase the project timeline by 113 days, and authorizing the City Manager to execute an agreement for the same.

 

 

 

Background:

This Change Order No. 2 will adjust the contract time and price to reflect additional work required in order to complete the project. The overall project time will be extended by 113 days for a total of 233 days. The contractor had to work in different parts of area 3 while awaiting acquisition agreement letters. The additional time was needed due to the number of driveways where the second and third panel had to be removed to maintain ADA compliance. Adding the extra work significantly delayed the contractor, as well as overrunning driveway quantities.

 

Change Order No. 1 addressed conflicts in the field and the Public Works staff determined the best course of action was to add the items as follows: Type B ADA ramps, stamped concrete, sidewalk with Integral curb, and 6" and 12" monolitic curb. The Change order was approved administratively per the City's Procurement Policy. 

 

 

Impact/Analysis:

This project is expected to close remnant gaps and will help to increase non-motorized mobility and safety within neighborhoods throughout the City.
