An Ordinance authorizing execution of an agreement for facility relocation by and between the City of Lee’s Summit, Missouri, and Spire Missouri Inc. in the amount of $535,643.00 for the Colbern Road Improvements from M350 Highway to Douglas Street, and authorizing the City Manager to execute the same.

 

 

Key Issues:

                     The City is engaged in finalizing the bidding of the Colbern Road Improvements from M350 Highway to Douglas Street (hereinafter “Project”).

                     Spire Energy’s gas line, currently located in a private easement, is in conflict with road widening, sidewalk installation, drainage installation, grade cuts and fills with three portions of the City’s Project.

                     Spire Energy is willing to relocate their facilities from the three portions of the City’s Project if the City pays the actual cost to perform the work.

                     City staff desires to enter into an agreement with Spire Energy to perform the relocation of their facilities for the agreed upon payment estimate, paid by the City to Spire Energy prior to the relocation.

 

Proposed Committee Motion:

I move to recommend to City Council approval of an Ordinance authorizing execution of an agreement for facility relocation by and between the City of Lee’s Summit, Missouri, and Spire Missouri Inc. in the amount of $535,643.00 for the Colbern Road Improvements from M350 Highway to Douglas Street, and authorizing the City Manager to execute the same.

 

 

Proposed City Council Motion:

First Motion:  I move for a second reading of an Ordinance authorizing execution of an agreement for facility relocation by and between the City of Lee’s Summit, Missouri, and Spire Missouri Inc. in the amount of $535,643.00 for the Colbern Road Improvements from M350 Highway to Douglas Street, and authorizing the City Manager to execute the same.

 

Second Motion:  I move for adoption of an Ordinance authorizing execution of an agreement for facility relocation by and between the City of Lee’s Summit, Missouri, and Spire Missouri Inc. in the amount of $535,643.00 for the Colbern Road Improvements from M350 Highway to Douglas Street, and authorizing the City Manager to execute the same.

 

Background:

In February 2019, the City entered into an agreement with Garver, LLC to proceed with professional engineering services on the Colbern Road Improvements from M350 Highway to Douglas Street.  During preliminary survey and design, Garver discovered potential conflicts with Spire Energy’s existing facilities along the north side of the corridor. 

Through plan sharing and meetings with Spire during the design process, it was concluded that Spire’s facilities would need to be relocated and rebuilt due to conflicts with three portions of the City’s Project.  The gas pipeline is either in conflict with the new roadway alignment, new sidewalk alignment, new drainage features or grading of new roadside slopes with the three portions of the City’s Project.  Spire has finalized their relocation design for the corridor.  There are two gas regulator stations and approximately 4500 ft. of 8" - 12” gas pipeline which require relocation.  The gas pipeline is currently located in a private gas easement (City pays for relocation).     

Spire has estimated the City’s responsibility of the relocation cost.  City staff desires to enter into the negotiated Spire Missouri Inc. Facility Relocation and Adjustment Agreement which requires the City to pay the estimated amount to Spire prior to the relocation work beginning.  Following the completion of the relocation work, Spire will determine the actual cost of the relocation and will either bill or refund the City the difference.
