Issue/Request:

An Ordinance approving an Intergovernmental Agreement Regarding Cost Sharing for Road Maintenance and Overlay and a Regarding Capital Improvement Project paid for by the City of Lee’s Summit and Jackson County to Mill & Overlay Langsford Road (West of Blackwell Road to Wildfower Drive) and authorizing the Mayor to execute the same.

 

 

Key Issues:

                     The southern half of Langsford Road lies within the boundaries of City of Lee's Summit, Missouri, (hereinafter "City") and portions of the northern half lie within the boundaries of unincorporated Jackson County, Missouri;

                     The City has agreed to improve Langsford Road, including the County's jurisdiction from 400 feet west of Blackwell Road east to eastern City limit (Wildflower Drive) as part of the Mill & Overlay FY24 Program, Jackson County shares the cost for the jointly-owned road sections (hereinafter "Improvements").

                     The City and Jackson County desire to enter into an Intergovernmental Agreement to set forth the obligations regarding cost, construction and maintenance sharing of the Improvements (hereinafter "Intergovernmental Agreement").

 

 

Proposed Committee Motion:

I move to recommend to City Council approval of an Ordinance approving an Intergovernmental Agreement Regarding Cost Sharing for Road Maintenance and Overlay and a Regarding Capital Improvement Project paid for by the City of Lee’s Summit and Jackson County to Mill & Overlay Langsford Road (West of Blackwell Road to Wildfower Drive) and authorizing the Mayor to execute the same.

 

 

Proposed City Council Motion:

FIRST MOTION: I move for second reading of an Ordinance approving an Intergovernmental Agreement Regarding Cost Sharing for Road Maintenance and Overlay and a Regarding Capital Improvement Project paid for by the City of Lee’s Summit and Jackson County to Mill & Overlay Langsford Road (West of Blackwell Road to Wildfower Drive) and authorizing the Mayor to execute the same.

 

SECOND MOTION: I move for adoption of an Ordinance approving an Intergovernmental Agreement Regarding Cost Sharing for Road Maintenance and Overlay and a Regarding Capital Improvement Project paid for by the City of Lee’s Summit and Jackson County to Mill & Overlay Langsford Road (West of Blackwell Road to Wildfower Drive) and authorizing the Mayor to execute the same.

 

Background:

Langsford Road is shared by the jurisdictions of Jackson County and Lee's Summit from 400 feet west of Blackwell Road easterly to the east City limit of Lee's Summit. This area of Langsford Road was originally split along the centerline between the City of Lee’s Summit and Jackson County.  As Lee's Summit has developed north of Langsford road (Lee’s Summit Fire Station No.6 and the Legacy Wood Subdivision) portions of the north section have been annexed into the city limits of Lee's Summit.

 

This section of road split between Lee’s Summit and Jackson County is approximately .9 mile in length. In accordance with the Cooperative Agreement for Road Maintenance and Snow Removal, dated June 25, 2008, general maintenance, which includes crack sealing, pothole repair, full depth patching, and snow removal, is the responsibility of Jackson County.  The agreement states that capital improvements, such as mill an overlay or bridge replacements, is the responsibility of the entity with jurisdiction.  This means Lee’s Summit is responsible to mill and overlay the south half the road (the eastbound lane), portions of west bound Langsford within the City, leaving the remainder of the road under Jackson County’s responsibility to mill and overaly.

 

It is has been common practice for the local agencies to collaborate on many capital projects to make improvements to the entire roadway instead of segmenting the work individually.  Sharing of resources usually reduces the overall cost and administrative cost of construction work.  With both the County and the City sharing jurisdiction, Jackson County is agreeing to share the cost of the mill & overlay utilizing the City's Mill & Overlay FY24 contract.    This agreement authorized the City to receive payment from Jackson County to complete the work in Jackson County’s jurisdictional limits in accordance with the agreement.

 

In addition to being considered by The Lee's Summit City Council, the agreement is concurrently being considered by the County Legislature of Jackson County, Missouri.  Section 17 of the Agreement (17. Counterparts) states "This Agreement may be executed in two or more counterparts, each of which shall be deemed to be an original but all of which together shall be deemed to be one and the same instrument".

 

 

Impact/Analysis:

If the event the City or the County does not approve this agreement, the work along Langsford Road will be removed from the current contract.
