An Ordinance amending the Code of Ordinances of the City of Lee's Summit, Missouri by repealing, Article VIII, Controlled Substances of Chapter 17, Offenses, and enacting in lieu thereof a new Article VIII, Controlled Substances of Chapter 17. On November 8, 2022 the voters of the State of Missouri approved Amendment 3 to the constitution providing for adult use marijuana for those 21 years of age or old. This is in addition to medical marijuana approved as a constitutional amendment on November 6, 2018. As you recall, we made substantial changes to various ordinances back in 2019 in response to the medical marijuana amendment. Similarly, we are required to amend various portions of our ordinances in response to the adult use marijuana amendment. This ordinance updates Chapter 17 Controlled Substances to take into account the legalization of adult use marijuana and modifies the jurisdiction of the municipal court to include offenses that result only in a civil penalty. Specifically, this ordinances makes provision for possession of adult use marijuana for persons 21 years of age but prohibits the possession of adult use marijuana for those under age 21. Additionally, it prohibits possession of drug paraphernalia for use with controlled substances other than marijuana and allows use of such accessories with marijuana. Finally, the provisions of this ordinance recognize that persons under 21 may possess medical marijuana under certain circumstances.
