Title

An Ordinance amending the Code of Ordinances by repealing Section 1-13. Penalties for Code, Ordinance Violations. and enacting in lieu thereof a new Section 1-13. Penalties for Code, Ordinance Violations dealing generally with making certain amendments to provide for adult use marijuana and to enhance the clarity of the provision. (CEDC 1/11/23)

 

 

Body

On November 8, 2022 the voters of the State of Missouri approved Amendment 3 to the constitution providing for adult use marijuana for those 21 years of age or old.  This is in addition to medical marijuana approved as a constitutional amendment on November 6, 2018.  As you recall, we made substantial changes to various ordinances back in 2019 in response to the medical marijuana amendment.  Similarly, we are required to amend various portions of our ordinances in response to the adult use marijuana amendment.  This ordinance provides for the penalties for certain marijuana related offenses.  Under the new Constitutional provision several offenses now are subject only to a civil penalty and not the criminal penalties previously provided by this provision.  This amendment provides for those civil penalties and make certain other clarifying amendments to enhance the readability of the section.

Recommendation:  Staff recommends approval of this ordinance.

Penalties for Code, Ordinance Violations. and enacting in lieu thereof a new Section 1-13. Penalties for Code, Ordinance Violations dealing generally with making certain amendments to provide for adult use marijuana and to enhance the clarity of the provision.
