Issue/Request:
An Ordinance approving Change Order No. 5 to the Agreement for the construction of the Arnold Hall Stormwater Improvements Project, Project No. 54-13, between the City of Lee's Summit, Missouri, and Tasco, LLC, to increase the project timeline by 21 calendar days, and authorizing the City Manager to execute the same.
Key Issues:
• Pursuant to Ordinance No. 9176, the City and Tasco, LLC, (hereinfter "Contractor") entered into an Agreement for the construction of the Stormwater Improvements: NE Delta School Road, Project No. 54-13 (hereinafter "Base Agreement").
• Pursuant to the change order approval process prescribed in the City’s Procurement Policy, the City and Contractor administratively modified the Base Agreement, as amended, per Change Orders 1 through 4 to adjust the Contract price.
• The City desires to further modify the Base Agreement, as amended, to adjust construction contract time to allow for compensable material delivery delays due to supply chain issues, and additional time to complete the project in two phases.

I move to recommend to City Council approval of an Ordinance approving Change Order No. 5 to the Agreement for the construction of the Arnold Hall Stormwater Improvements Project, Project No. 54-13, between the City of Lee's Summit, Missouri, and Tasco, LLC, to increase the project timeline by 21 calendar days, and authorizing the City Manager to execute the same.

FIRST MOTION: I move for a second reading of an Ordinance approving Change Order No. 5 to the Agreement for the construction of the Arnold Hall Stormwater Improvements Project, Project No. 54-13, between the City of Lee's Summit, Missouri, and Tasco, LLC, to increase the project timeline by 21 calendar days, and authorizing the City Manager to execute the same.
SECOND MOTION: I move for adoption of an Ordinance approving Change Order No. 5 to the Agreement for the construction of the Arnold Hall Stormwater Improvements Project, Project No. 54-13, between the City of Lee's Summit, Missouri, and Tasco, LLC, to increase the project timeline by 21 calendar days, and authorizing the City Manager to execute the same.
Background:
This Change Order addresses increasing contract time to construct the project in two phases in lieu of a single phase as bid.
Material delivery delays, due to supply chain issues, of the stormwater retention tanks (R-tanks) installed as part of the overall project, had a significant impact on project progress.
R-tanks were identified as a problem for delivery at the beginning of the project. Global delivery issues caused by the pandemic significantly impacted their oversees producer and their ability to ship this product. The R-tank delivery was delayed by 6 months.
Due to the delivery delay this project was pushed into two construction seasons.
