Issue/Request:
An Ordinance approving Modification No. 2 to an Agreement for Professional Engineering Services for the Browning Street Extension from Browning Street to Hamblen Road (RFQ No. 568-32372) between the City of Lee's Summit, Missouri, and Bartlett & West, Inc., for an increase of $31,469.00 with an amended not to exceed amount of $245,190.00, and authorizing the City Manager to execute the same.
Key Issues:
• Pursuant to Ordinance No. 8581, the City and Bartlett & West, Inc. (hereinafter "Engineer") entered into an Agreement for Professional Engineering Services for the Browning Street Extension from Browning Street to Hamblen Road (RFQ No. 568-32372) dated March 26, 2019 (hereinafter "Base Agreement").
• Pursuant to Ordinance No. 8717, the City and Engineer modified the Base Agreement per Modification No. 1 dated September 24, 2019, to allow negotiation of additional right-of-way acquisition with UPRR and to design a sewer main extension.
• Engineer has submitted a proposal with estimated costs to provide construction administration services for this project (hereinafter "Services").
• The City desires to further modify the Base Agreement, as amended, with Engineer to provide these additional Services.

I move to recommend to City Council approval of an Ordinance approving Modification No. 2 to an Agreement for Professional Engineering Services for the Browning Street Extension from Browning Street to Hamblen Road (RFQ No. 568-32372) between the City of Lee's Summit, Missouri, and Bartlett & West, Inc., for an increase of $31,469.00 with an amended not to exceed amount of $245,190.00, and authorizing the City Manager to execute the same.

FIRST MOTION: I move for a second reading of an Ordinance approving Modification No. 2 to an Agreement for Professional Engineering Services for the Browning Street Extension from Browning Street to Hamblen Road (RFQ No. 568-32372) between the City of Lee's Summit, Missouri, and Bartlett & West, Inc., for an increase of $31,469.00 with an amended not to exceed amount of $245,190.00, and authorizing the City Manager to execute the same.
SECOND MOTION: I move for adoption of an Ordinance approving Modification No. 2 to an Agreement for Professional Engineering Services for the Browning Street Extension from Browning Street to Hamblen Road (RFQ No. 568-32372) between the City of Lee's Summit, Missouri, and Bartlett & West, Inc., for an increase of $31,469.00 with an amended not to exceed amount of $245,190.00, and authorizing the City Manager to execute the same.
Background:
The City and Engineer entered into an Agreement for Professional Engineer Services for the Browning Street Extension from Browning Street to Hamblen Road (RFQ No. 568-32372) dated March 26, 2019, to extend SE Browning Street from its current termination and connect with SE Hamblen Road. During design, the Engineer's scope was amended per Modification No. 1 dated September 24, 2019, to allow for the negotiation of additional right-of-way from UPRR along SE Hamblen Road and to include the design of an 8-inch sewer main extension to the western limits of Water Utilities' property along Browning Street.
Staff has advertised for bids for the construction of this Project; the award of that contract is being presented separately. The City desires to further modify the agreement with the Engineer for them to provide construction administration services for the Project (Modification No. 2). The Contractor will be required to submit shop drawings and materials certifications from suppliers that must be reviewed by the Engineer to ensure conformance with the Project's plans and specifications. Other engineering support during construction will include plan revisions as needed based upon actual conditions in the field, reviewing change orders, answering questions related to the project design, attending periodic construction progress meetings, participating in the substantial completion walk-through, and preparing the post-construction record drawings for City records. Modification No. 2 for these construction services will authorize an additional fee up to $31,469.00, with a total fee of up to $245,190.00.
