Issue/Request:
An Ordinance approving Change Order No. 3 to the Agreement for the construction of the Stormwater Improvements: NE Delta School Road, Project No. 576322-5C, between the City of Lee's Summit, Missouri, and Infrastructure Solutions, LLC, to adjust for final quantities and to increase the project timeline by 120 calendar days, and authorizing the City Manager to execute the same.
Key Issues:
• Pursuant to Ordinance No. 9131, the City and Infrastructure Solutions, LLC (hereinafter "Contractor") entered into an Agreement for the construction of the Stormwater Improvements: NE Delta School Road, Project No. 576322-5C (hereinafter "Base Agreement").
• Pursuant to Ordinance No. 9267, the City and Contractor modified the Base Agreement per Change Order No. 1 for increased costs primarily due to a concrete parking lot repair and a water main conflict that required relocation.
• The City and Contractor further modified the Base Agreement, as amended, per Change Order No. 2 to provide for the relocation of a sanitary sewer line conflict and installation of a commercial trash enclosure.
• The City desires to further modify the Base Agreement, as amended, to adjust for final quantities and to increase the project timeline by 120 calendar days due to time impacts to the critical path by the extra work identified in Change Orders No. 1 & No. 2. (hereinafter "Change Order No. 3").

City Council Motion:
FIRST MOTION: I move for a second reading of an Ordinance approving Change Order No. 3 to the Agreement for the construction of the Stormwater Improvements: NE Delta School Road, Project No. 576322-5C, between the City of Lee's Summit, Missouri, and Infrastructure Solutions, LLC, to adjust for final quantities and to increase the project timeline by 120 calendar days, and authorizing the City Manager to execute the same.
SECOND MOTION: I move for adoption of an Ordinance approving Change Order No. 3 to the Agreement for the construction of the Stormwater Improvements: NE Delta School Road, Project No. 576322-5C, between the City of Lee's Summit, Missouri, and Infrastructure Solutions, LLC, to adjust for final quantities and to increase the project timeline by 120 calendar days, and authorizing the City Manager to execute the same.
Background:
This Change Order will adjust both the contract time and contract price. The time will be extended, and the overall cost will be reduced.
The contract time to account for a number of delays that significantly impacted the project's critical path timeline by adding 120 calendar days. This results in revise contract time of 270 calendar days.
As presented on Change Order #1, a conflict was encountered with an existing waterline and the installation of the proposed 51"x32" RCPA culvert. This change provided for movement of the existing waterline to include all ancillary items to reconnect and restore areas disturbed by the relocation.
As presented on Change Order #2, a conflict was encountered with an existing sanitary sewer main and the installation of the proposed 51"x32" RCPA culvert. This 8" pipe, along with a 4" sewer service connection, was required to be lowered and reconnected to provide clearance from the proposed box culvert storm sewer installation. Additionally, a commercial trash enclosure and adjacent parking facility was required to be replaced / constructed due to the circumstances involved with adjusting the existing sanitary sewer.
Upon completing Change Order #1 and #2, which involved the additional work as presented, time as a component of the work was not included in the previous change orders for the additional work items. This change provides for an adjustment of time that encompasses the surveying, design, material acquisition and construction of the sanitary sewer adjustments and trash enclosure.
This change adjusts for field measured quantities of seeding, sodding and turf reinforcement mat. The final field measured quantities provided a net savings to the project of $14,188.50 for a revised agreement amount of $1,163,248.34.
