Issue/Request:
An Ordinance approving Change Order No. 3 to the agreement with Linaweaver Construction, Inc. for the Lea Drive Stormwater project, an increase of $14,943.25 for a revised contract amount of $2,085,800.55 and an increase of 35 calendar days to the overall project completion date and authorizing the execution of the same.
Key Issues:
• Change Order #1 added 21 calendar days as a result of utility delays beyond the contractor’s control.
• The 21 days added did not consider the seasonal impact of the delay.
• The MoDOT weighted timetable was used to evaluate the seasonal impact, resulting in an additional 33 calendar days being added as a result of the utility delay.
• 2 calendar days are being added as a result of abnormal weather conditions for the month of October in accordance with the contract documents.
• Various routine quantity adjustments are also being addressed.

I move to recommend to City Council approval of an Ordinance approving Change Order No. 3 to the agreement with Linaweaver Construction, Inc. for the Lea Drive Stormwater project, an increase of $14,943.25 for a revised contract amount of $2,085,800.55 and an increase of 35 calendar days to the overall project completion date and authorizing the execution of the same.
Background:
Change Order No. 1 addressed the actual time delay incurred by the contractor as a result of the gas main relocation. This resulted in 21 calendar days being added to the contract. Typically, the seasonal impact of the delay is also taken into consideration. Unfortunately, this was inadvertently overlooked when evaluating this utility delay. The adjustment for seasonal impacts is necessary as a day lost in July is much more valuable than a day added in November. The MoDOT weighted timetable was used to evaluate the seasonal impact of the 21 lost days in June/July to determine the equivalent number of days to add back in November/December to account for lost productivity. This evaluation is attached to the Packet for reference. 2 calendar days are also being added for abnormal weather conditions in accordance with the contract documents. In addition to the calendar days, several routine quantity adjustments are be addressed with this Change Order. Change Order #2 was processed administratively per the city's Procurement Policy (less than 5% increase) and had no impact on the time extension. Since we are adding more than 10% of the original contract time with this Change Order, City Council approval is required.
