Issue/Request:

An Ordinance approving a Quitclaim Deed between the City of Lee’s Summit, Missouri, and the Missouri Highways and Transportation Commission to adjust the City/State right-of-way limits along a portion of Chipman Road, and authorizing the Mayor to execute the same.

 

Key Issues:

                     The Missouri Highways and Transportation Commission (hereinafter "MoDOT") has proposed an adjustment to the City/State right-of-way (ROW) boundaries along a portion of Chipman Road to a more practical delineation for future maintenance needs.

                     The City desires to convey a portion of the City's ROW to MoDOT as reflected in the Quitclaim Deed.

                     As part of this arrangement, MoDOT will be conveying to the City an equal area of land of their ROW.

 

 

Proposed Committee Motion:

I move to recommend to City Council approval of an Ordinance approving a Quitclaim Deed between the City of Lee’s Summit, Missouri, and the Missouri Highways and Transportation Commission to adjust the City/State right-of-way limits along a portion of Chipman Road, and authorizing the Mayor to execute the same.

           

 

Proposed City Council Motion:

FIRST MOTION: I move for a second reading of an Ordinance approving a Quitclaim Deed between the City of Lee’s Summit, Missouri, and the Missouri Highways and Transportation Commission to adjust the City/State right-of-way limits along a portion of Chipman Road, and authorizing the Mayor to execute the same.

 

SECOND MOTION: I move for adoption an Ordinance approving a Quitclaim Deed between the City of Lee’s Summit, Missouri, and the Missouri Highways and Transportation Commission to adjust the City/State right-of-way limits along a portion of Chipman Road, and authorizing the Mayor to execute the same.

 

 

Background:

During design of the State Chipman Road bridge replacement project at US 50 Highway, MoDOT contacted the City Traffic Engineer to inquire about the City’s interest to clean-up the existing irregular City/State Right of Way (ROW) line west of the US 50 Highway bridge along and across Chipman Road.  From a point on the north ROW line, the existing City/State ROW line angles to the southwest across the west bound lanes, then moves straight south across the east bound lanes to the curb and gutter, then angles back southeast where it meets a point on the south ROW line (refer to purple line on attached Aerial Map).  This existing irregular shaped City/State ROW line has caused some confusion in recent years regarding severe pothole maintenance responsibilities in the westbound lanes of Chipman Road.  Utilizing budget from the bridge project, MoDOT tasked their consultant/surveyor to calculate and write a legal description which would provide for a straight north/south ROW delineation of equal area of land for both entities (refer to orange line at Station 18+25.71 on attached Aerial Map) so that neither jurisdiction gained or lost total ROW.  A clean delineation of responsibility/ownership is preferred to the current condition and should avoid confusion in the future.
