Issue/Request:
An Ordinance authorizing the execution of a Municipal and Cost Apportionment Agreement between the City of Lee's Summit, Missouri, and the Missouri Highways and Transportation Commission for the construction, maintenance, and payment activities related to the public improvement project designated as Route 50, Jackson County, Job J4P3009, bridge(s) replacement over Chipman Road within the City limits of Lee's Summit, Missouri.
Key Issues:
• The Missouri Department of Transportation (MoDOT) intends to replace the bridges along US 50 over Chipman Road and improve traffic safety along portions of the State's right-of-way on Chipman Road (hereinafter "Job J4P3009").
• Job J4P3009 is scheduled to begin construction in the spring of 2022.
• Job J4P3009 will be done in both City and MoDOT rights-of-ways, during which the portions of the City roads impacted will temporarily become part of the state system for the duration of construction, and then will return to the City upon completion.
• The City is participating in the cost for the bridge enhancements with the use of the Capital Improvement Sales Tax. These enhancements consist of aesthetics above and beyond MoDOT standards with a total estimated cost of $75,360.00
• An agreement between the City and MoDOT is necessary for the construction, maintenance, and payment arrangement for the bridge enhancements for Job J4P3009 (hereinafter “Municipal and Cost Apportionment Agreement”)

I move to recommend to City Council approval of an Ordinance authorizing the execution of a Municipal and Cost Apportionment Agreement between the City of Lee's Summit, Missouri, and the Missouri Highways and Transportation Commission for the construction, maintenance, and payment activities related to the public improvement project designated as Route 50, Jackson County, Job J4P3009, bridge(s) replacement over Chipman Road within the City limits of Lee's Summit, Missouri.
Proposed City Council Motion:
FIRST MOTION: I move for second reading of an Ordinance authorizing the execution of a Municipal and Cost Apportionment Agreement between the City of Lee's Summit, Missouri, and the Missouri Highways and Transportation Commission for the construction, maintenance, and payment activities related to the public improvement project designated as Route 50, Jackson County, Job J4P3009, bridge(s) replacement over Chipman Road within the City limits of Lee's Summit, Missouri.
SECOND MOTION: I move for adoption of an Ordinance authorizing the execution of a Municipal and Cost Apportionment Agreement between the City of Lee's Summit, Missouri, and the Missouri Highways and Transportation Commission for the construction, maintenance, and payment activities related to the public improvement project designated as Route 50, Jackson County, Job J4P3009, bridge(s) replacement over Chipman Road within the City limits of Lee's Summit, Missouri.
Background:
The US 50 bridges over Chipman Road are scheduled for replacement by MoDOT in 2022. A project webpage has been created for additional information and reference at https://www.modot.org/us-50-over-chipman-rd
Impact/Analysis:
This is a typical municipal agreement between the City and MoDOT with regard to MoDOT improvements. This agreement will allow MoDOT to work on City right-of-way and take temporary ownership of City right-of-way for the construction of improvements. The City is required to retain its existing interest in City right-of-way upon completion of the project. There is no permanent right of way exchange on this project. There is an exchange of funds of approximately $75,360.00 from the City to the Missouri Highways and Transportation Commission for enhancement of the bridges with the use of concrete formliners.
The project, to be completed by MoDOT, will require the closure of Chipman Road to through traffic to ensure the shortest possible construction timeline. US 50 traffic will be able to exit and make a right turn only onto Chipman Road during construction. Chipman Road traffic will not be able to pass under US 50 Highway. Detour Routes will be established on City streets.

Committee Recommendation: The Public works Committee voted unanimously 3-0 (Councilmember Carlyle "Absent"), to recommend to City Council approval of an Ordinance authorizing the execution of a Municipal and Cost Apportionment Agreement between the City of Lee's Summit, Missouri, and the Missouri Highways and Transportation Commission for the construction, maintenance, and payment activities related to the public improvement project designated as Route 50, Jackson County, Job J4P3009, bridge(s) replacement over Chipman Road within the City limits of Lee's Summit, Missouri.
