Proposed City Council Motion:
FIRST MOTION: I move for a second reading of an Ordinance amending Chapter 29 Traffic and Motor Vehicles, Sec. 29-514 Protective Headgear for Motorcyclists of the Code of Ordinances of the City of Lee's Summit, Missouri by repealing the Section in its entirety.

SECOND MOTION: I move for adoption of an Ordinance amending Chapter 29 Traffic and Motor Vehicles, Sec. 29-514 Protective Headgear for Motorcyclists of the Code of Ordinances of the City of Lee's Summit, Missouri by repealing the Section in its entirety.

Background:
The Missouri Legislature passed and the Governor signed House Bill 7 1963 (“H.B. 1963”) , a bill containing provisions relating to transportation, as a part of legislation enacted in its 2020 Regular Session.

The H.B.1963 in part amends the existing Revised Missouri Statute, Section 302.020.2, by adding a provision that expressly prohibiting any political subdivision of the state from imposing a protective headgear requirement on the operator or passenger of a motorcycle or motortricycle.
This legislation preempts the existing Lee’s Summit City Code Section 29-514, ‘Protective Headgear for Motorcyclists,’ which requires such operators and passengers to wear protective headgear at all times when the motorcycle is in motion.

To comply with the legislation, the City needs to repeal the helmet requirement for motorcyclists from it's ordinances.
