Issue/Request:

An Ordinance authorizing the execution of a license agreement by and between the Oaks Ridge Meadows Homeowners Association and the City of Lee's Summit, Missouri, for the installation and maintenance of improvements to a portion of the City's Rights-of-Way along NE Anderson Drive.

 

Key Issues:

                     The license agreement would allow the Oaks Ridge Meadows Homeowners Association to install and maintain a solar powered flashing crosswalk sign assembly at the existing signed and marked crosswalk located along NE Anderson Drive in front of the Oaks Ridge Meadows community pool.  The location is illustrated in Exhibit A.

                     The existing crosswalk does not meet conditions for City funding and installation of enhanced crosswalk signage/treatments above and beyond the existing signs and markings.  However, staff supports the HOA's request to install such crosswalk enhancements.  The requested crosswalk enhancements are allowable standard devices in accordance with the MUTCD.  The requested crosswalk enhancements are intended to address resident safety concerns.

                     All installed materials would be subject to City staff approval and must be maintained by the HOA.  The materials depicted in Exhibit B are illustrative and alternatives may be considered similar to installations that exist along Ward Road near Westview Elementary or that exist along Longview Road near the Rock Island Trail.  The City will have no costs associated with the improvements covered by the license agreement.  The City would continue to maintain the crosswalk markings and any existing related signs that remain in-place.

 

Proposed City Council Motion:

FIRST MOTION:  I move for a second reading of an Ordinance authorizing the execution of a license agreement by and between the Oaks Ridge Meadows Homeowners Association and the City of Lee's Summit, Missouri, for the installation and maintenance of improvements to a portion of the City's Rights-of-Way along NE Anderson Drive.

 

SECOND MOTION:  I move for adoption of an Ordinance authorizing the execution of a license agreement by and between the Oaks Ridge Meadows Homeowners Association and the City of Lee's Summit, Missouri, for the installation and maintenance of improvements to a portion of the City's Rights-of-Way along NE Anderson Drive.

 

 

 

Background:

The residents of Oaks Ridge Meadows requested the City install flashing crosswalk signs at the existing mid-block crosswalk along NE Anderson Drive adjacent to their community pool and near Voy Spears Elementary School.  The Oaks Ridge Meadows subdivision is located on both sides of NE Anderson Drive.  The City has installed crosswalk markings and signs.  Staff found that the location did not meet minimum conditions set forth by City policies necessary for City prioritization and funding to enhance the existing crosswalk further by addition of the requested lights, pedestrian actuation, etc.  Staff supports the Oaks Ridge Meadows Homeowners Association (HOA) initiative to install and maintain the improvements.  A license agreement with the Oaks Ridge Meadows HOA is required to authorize the use of right-of-way and allow them to procure, install and maintain such improvements at their cost subject to City review and approval with MUTCD compliance.  The HOA is agreeable to the license agreement terms and conditions.  Similar license agreements have been executed with other entities (e.g. HOA's) for right-of-way improvements.
