Issue/Request:
An Ordinance authorizing the execution of an agreement by and between the City of Lee’s Summit, Missouri, and Walter P. Moore and Associates, Inc. in an amount not to exceed $171,000.00 for Professional Engineering Services for Main Street Improvements from Chipman Road to Commerce Drive, and authorizing the City Manager to enter into an agreement for the same.
Key Issues:
• Public Works Staff recommends a sole source agreement with Walter P. Moore and Associates, Inc. for professional engineering services in support of the NW Main Street Improvement Project from NW Chipman to Commerce Drive.
• Walter P. Moore and Associates, Inc. was previously selected for the engineering services required for the NW Commerce Drive Street Improvement Project by Qualification Based Selection as part of RFQ No. 2017-305, which overlaps the NW Main Street project.
• Walter P. Moore has unique experience, knowledge, and technical data of the Main Street project area by completing work that can be incorporated into the Main Street Improvement Project
• Changing the engineering services provider for the Main Street from Chipman Road to Commerce Drive project would lead to inefficiencies and loss of work already completed and paid for with the NW Commerce Drive Street Improvement project.
• This project is funded from the License (Excise) Tax fund.

FIRST MOTION: I move for a second reading of an Ordinance authorizing the execution of an agreement by and between the City of Lee’s Summit, Missouri, and Walter P. Moore and Associates, Inc. in an amount not to exceed $171,000.00 for Professional Engineering Services for Main Street Improvements from Chipman Road to Commerce Drive, and authorizing the City Manager to enter into an agreement for the same.
SECOND MOTION: I move for adoption of an Ordinance authorizing the execution of an agreement by and between the City of Lee’s Summit, Missouri, and Walter P. Moore and Associates, Inc. in an amount not to exceed $171,000.00 for Professional Engineering Services for Main Street Improvements from Chipman Road to Commerce Drive, and authorizing the City Manager to enter into an agreement for the same.
Background:
The primary purpose of this project is to facilitate economic development by re-constructing existing infrastructure that has deteriorated, and improve the existing roadway conditions of this section of Main Street. This section of roadway is a generally unimproved, has narrow lanes, is uncurbed with roadside ditches, and no shoulders. This section is located between Chipman Road, an improved major arterial, and Commerce Drive, an improved commercial collector. It is the only unimproved section of roadway in the immediate area and an impediment to development in the area. This project will enhance access to several undeveloped or underdeveloped properties (including property owned by the City) and encourage economic activity. Any adjacent property development would otherwise be required to improve Main Street in addition to other required infrastructure improvements. The project will also improve roadway safety and capacity. This project was identified in the Thoroughfare Master Plan and has been recommended by the License Tax Committee.
Walter P. Moore and Associates, Inc. was previously selected for the engineering services required for the NW Commerce Drive Street Improvement Project by Qualification Based Selection as part of RFQ No. 2017-305 in accordance with state statutes and local procurement policies. The Commerce drive design included surveying and designing the intersection of Main Street, locating the water transmission mains, and designing sidewalks between Main and Chipman that will be built as part of this project. This previous work provides Walter P. Moore and Associates, Inc. expertise and knowledge of the project area that will save both time and money on the Main Street project.
The contract with Walter P. Moore and Associates, Inc. for the Commerce Drive Street Improvement Project was approved in February 2017 and concluded in November 2019 with the successful construction of the roadway project. Section 7.2 of the City’s current Purchasing Policy Manual states "The Procurement and Contract Services Manager may waive the requirement of competitive bids or proposals for supplies/services when he/she has determined in writing the following conditions: ... d. A firm has significant previous or specialized knowledge on a proposed project that would result in significant monetary and/or time savings in completion of the project.” The previously completed work can be incorporated into the Main Street Improvement Project and rebid as part of that project. Changing the engineering services provider for the Main Street from Chipman Road to Commerce Drive project would lead to inefficiencies and loss of work already completed and paid for with the NW Commerce Drive Street Improvement project.
Impact/Analysis:
This is the City's standard agreement between the City and a consulting engineering firm with regard to engineering services. This agreement will allow Walter P. Moore and Associates, Inc. to provide engineering services to the City. Using the sole source process will save time and money on this project.
