Key Issues:

The Ward Road Improvement project requires relocation of Cass County PWSD#3 water line due to conflicts with the improvements.

The Cass County PWSD#3 waterline conflicts with portions of the improvements that are within private easements and street right of way.

The Cass County PWSD#3 water line is being upgraded and moved into private easement for the length of the project.

This agreement is necessary for the relocation of the water line as part of the Ward Road Improvement project (County Line Road to Gore Road)

 

Proposed City Council Motion:

I move for a second reading of an ordinance authorizing the execution of an interlocal governmental agreement between the City of Lee's Summit and Cass County Public Water Supply District No. 3 relating to the construction by Lee's Summit of a project for its use and part of a new water line for cass county water supply district no. 3's use and shared use of easement areas.

Background:

Improvements to Ward Road were approved by voters as part of the 2007 Capital Sales Tax Renewal. The PWSD#3 waterline is partly within right of way but mostly within private easement for half the length of the project. Water line within private easement that conflicts with the improvements will be funded by the City, with the remaining portion that is in conflict within the Right of Way being funded by the PWSD#3. During the course of design the PWSD#3 decided to replace and upgrade the entire water line for the length of the Ward Road Improvement project and will be constructed as part of the project. This agreement is being entered into with PWSD#3 to relocate the water line as part of the project and to pay a portion of the funds that would have gone to relocating areas outside of the Right of Way.

 

Impact/Analysis:

The bid price from the recommended contractor for the replacement of the water line is $149,195.20 of which the City will pay $24,674.67 total. The PWSD#3 will pay $124,520.53. The City will pay $8,008.00 as the per lineal foot charge, and $16,667.67 as the difference between the recommended bidder and the low bidder for the water line. The cost to the City is covered in the Ward Road Project Bid recommended to City Council at the August 21, 2018 Public Works Committee.
