Issue/Request:
An ordinance authorizing the execution of Modification No. 2 to the agreement with Affinis Corp. for Professional Engineering Services for Ward Road Improvements (County Line Road to Raintree Parkway)(RFQ No. 18532272-D) in the amount of $61,140.00 for a revised not to exceed contract amount of $604,335.00.
Key Issues:
- Affinis Corp. was awarded the design contract on February 10, 2016 for an original contract amount of $533,210.00 (Ordinance No. 7807)
- Modification No. 1 included additional scope related to sidewalk connectivity along County Line Road from Ward Road to Raintree Drive, retaining wall design and layout located at Tract 92 and 93, and additional Right of Way and Easement staking.
- Modification No. 1 approved an increase in design services totaling $9,885.00 and was less than a five percent (5%) increase to the one time design consultant contract, which was appropriately approved by the Department Director and City Manager.
- Modification No.2 requests an increase of $61,140.00 dedicated to Construction Phase Services and is an 11.5% increase from the original contract amount.
- The revised cost of the contract will be $604,335.00

Background:
Construction phase services are not generally scoped during the original contract due to uncertainty with respect to the tasks that may be required by the consultant. The construction of Ward Road between County Line Road and Gore Road is expected to begin in October 2018 after approval and recommendation of the low bidder. The construction phase of the project will require Consultant review of contract submittals, conducting a pre-construction and public meeting, attendance at progress meetings, answering of questions and review of issues related to design and/or modifications during construction, and providing final As-Built drawings to the City after final completion of the project.
