AN ORDINANCE AMENDING ARTICLE III.  OFFICERS AND EMPLOYEES. CHAPTER 2. ADMINISTRATION OF THE CODE OF ORDINANCES OF THE CITY OF LEE’S SUMMIT BY REPEALING SECTION 2-61 AND ENACTING TEN NEW SECTIONS RELATING TO A CODE OF ETHICS, FINANCIAL DISCLOSURE AND CODE OF CONDUCT.  (Rules 2-12-18)(Note: First reading by Council on March 1, 2018.)

In April 2017, the Citizens of the City of Lee's Summit approved Charter Question No. 3 requiring the City Council to enact an ethics code within one year of the effective date of the Charter Amendment.  The issue was referred to the City Council Rules Committee.  The Committee met numerous times to consider provisions of the ethics rules.  The Ordinance, as presented, provides definitions and regulations consistent with existing provisions of State Statute and the City of Lee's Summit Charter and is applicable in various parts to Elected officials and City Employees.  In addition to ethics rules, the ordinance provides a procedure for determining the existence of an ethical violation and if so found, a disciplinary procedure consistent with Constitutional due process.  This ordinance provides a code of conduct and incorporates financial reporting provisions previously approved by the Council.

 

 

Proposed Council Motion:

I move for adoption of AN ORDINANCE AMENDING ARTICLE III.  OFFICERS AND EMPLOYEES. CHAPTER 2. ADMINISTRATION OF THE CODE OF ORDINANCES OF THE CITY OF LEE’S SUMMIT by repealing section 2-61 and enacting ten new sections relating to a code of ethics, financial disclosure and code of conduct.

 

 

Recommendation

Staff recommends approval.  The Rules Committee forwarded this item to Council with a vote of 3-0.
