Body

Proposed City Council Motion:

I move for adoption of AN ORDINANCE AUTHORIZING THE EXECUTION OF A DEVELOPMENT AGREEMENT BETWEEN WI MAPLE 36, LLC AND THE CITY OF LEE’S SUMMIT, MISSOURI FOR THE MAPLE ESTATES DEVELOPMENT.

Issue/Request:

AN ORDINANCE AUTHORIZING THE EXECUTION OF A DEVELOPMENT AGREEMENT BETWEEN WI MAPLE 36, LLC AND THE CITY OF LEE’S SUMMIT, MISSOURI FOR THE MAPLE ESTATES DEVELOPMENT

Key Issues:

Attached is a Development Agreement covering the construction of certain off-site storm improvements required to serve the Maple Estates development.

On June 18, 2015, the City Council concluded a public hearing for Application #PL2015-041, for a preliminary development plan for the development of approximately 5 acres of land generally lying on the south side of NE Chipman Rd, at its intersection with NE Ridgeview Drive, on property owned by the Developer (“Property), which will be developed as Maple Estates ("Development").

On June 18, 2015, the City Council adopted Ordinance No. 7653 which approved Application #PL2015-041 subject to certain conditions of approval, one of which was a requirement that the Developer enter into a development agreement with the City to provide for certain off-site  improvements necessary for the Development.

The approval and execution of the attached Development Agreement fulfills the ordinance requirement as required in the preliminary development plan.
