AN ORDINANCE APPROVING AMENDMENT NO. 1 TO PARKING LOT FACILITY USE AGREEMENT BY AND BETWEEN THE CITY OF LEE'S SUMMIT, MISSOURI AND THE JUNIOR COLLEGE DISTRICT OF METROPOLITAN KANSAS CITY (A/K/A METROPOLITAN COMMUNITY COLLEGE) AND AUTHORIZING THE MAYOR TO EXECUTE THE SAME BY AND ON BEHALF OF THE CITY.
Key Issues:
MCC is requesting an amendment for the parking lot agreement for 2017 Tour de Lakes. The amendment includes details regarding use and conditions, schedule, and fees. The amendment clarifies operational details verbally agreed to in previous conversations. Although the event is over, MCC is requesting approval of the amendment for their records.
Proposed City Council Motion:
I move for adoption of AN ORDINANCE APPROVING AMENDMENT NO. 1 TO PARKING LOT FACILITY USE AGREEMENT BY AND BETWEEN THE CITY OF LEE'S SUMMIT, MISSOURI AND THE JUNIOR COLLEGE DISTRICT OF METROPOLITAN KANSAS CITY (A/K/A METROPOLITAN COMMUNITY COLLEGE) AND AUTHORIZING THE MAYOR TO EXECUTE THE SAME BY AND ON BEHALF OF THE CITY.
SECOND MOTION: AN ORDINANCE APPROVING AMENDMENT NO. 1 TO PARKING LOT FACILITY USE AGREEMENT BY AND BETWEEN THE CITY OF LEE'S SUMMIT, MISSOURI AND THE JUNIOR COLLEGE DISTRICT OF METROPOLITAN KANSAS CITY AND AUTHORIZING THE MAYOR TO EXECUTE THE SAME BY AND ON BEHALF OF THE CITY. I MOVE FOR ADOPTION.
Background:
The City Council approved Ordinance No. 8145 on May 4, 2017 authorizing execution of a facility use agreement between MCC and City of Lee's Summit for use of the Longview Recreation Center parking lot for Tour de Lakes which was held on Saturday, June 24, 2017. The City has entered into similar agreements over the past several years for the same use.
On Wednesday, June 21, 2017 MCC contacted the legal department and requested an amendment to the agreement. It is the City's understanding that MCC staff discovered that the wrong language was utilized for the 2017 Agreement, and that MCC intended to incorporate and utilize language virtually identical to language that was contained in a 2015 Agreement between the two parties for the same use.
MCC was notified by City staff that intergovernmental agreements, including Amendments to existing Agreements, must be approved by the City Council. MCC was also notified that the earliest opportunity for the City Council to review the Amendment would be July 13, 2017.
