Body

On October 26, 2016, an Affidavit of Petitioners Committee was filed in the office of the City Clerk, signed by five registered voters from District 4, requesting a petition to recall District 4 Councilmember Chris Moreno.  Once the members of the committee were confirmed to be registered voters in District 4, a petition form was created and returned to the Committee within three days, as required by Charter.

Section 10.3. Petitions, Subsection (a) Number of Signatures, of the Charter for the City of Lee’s Summit, Missouri, states a recall petiton requires at least thirty percent (30%) of the total number of votes cast for the office in the election in which that office was elected.  Based on the election certification for the election held on April 5, 2016, the City Clerk's Office determined that the petition required 524 signatures and the Committee had 60 calendars days after receipt of the petition form in which to file a complete petition.

A completed petition was filed in the Office of the City Clerk on December 8, 2016, and the petition was submitted to the Jackson County Board of Election Commissioners for verification of the signatures.  On December 9, 2016, the Jackson County Board of Election Commissioners returned the petitions with a confirmation stating the petition contained signatures of at least 621registered voters.

Section 10.6. Action on Initiative, Referendum and Recall Petitions, subsection (c), of the Charter, states when a recall petition has been certified to the Council as sufficient by the City Clerk, the Council shall, at its next meeting after receipt of such certification, fix a date for holding the election and the election is to be held at the next available regular or special election date as established by the Missouri election calendar.

On Monday, December 12, 2016, a Certificate of Sufficiency was e-mailed by the City Clerk to the Mayor and City Council.  In compliance with this section, attached is an ordinance calling for an election on April 4, 2017.
