Issue/Request:
The applicant proposes to vacate the subject right-of-way in association with the development of Pathways at Kensington Farms Phase 1. The subject right-of-way houses an existing street stub that is no longer needed to serve the area street network. The right-of-way and street stub conflict with the lot layout approved as part of the preliminary development plan for Pathways at Kensington Farms Phase 1. No objection to the proposed vacation of right-of-way has been raised by any private utility, the City’s Public Works or Water Utilities Departments.

Recommendation
Based on staff’s review and finding that the application meets the applicable requirements of the UDO and the Design & Construction Manual, staff supports the proposed application, subject to the conditions of approval outlined in the staff report.

On a motion by Mr. Yerington, seconded by Vice-Chair Touzinsky, the Planning Commission unanimously voted on October 8, 2026, to recommend approval of Application #PL2026-188 - Vacation of Right-of-Way - Street stub along SW Cornwall Road, west of SW Rupard Road (adjacent to 1408 SW Cornwall Road).
