An Ordinance authorizing the execution of a Memorandum of Understanding between the City of Lee's Summit, Missouri and QuikTrip Corporation

Key Issues:
- The M291 Hwy & US50 Hwy North Interchange Project requires coordination by and between the City, MHTC (MoDOT), Highway Patrol Troop A, LSR7 School District and QuikTrip.
- Property transactions in support of the project commence upon receipt of an A-Date from MoDOT, a date upon which the project is approved to acquire necessary property, right-of-way and easements necessary for the project. The A-Date was recently issued.
- Through a series of agreements, including the subject MOU with QuikTrip, land will transfer from MHTC to the City, from the City to QuikTrip, and from QuikTrip to the City, so that Blue Parkway can be relocated as shown in the project plans and QuikTrip can complete a redevelopment plan as shown in the Preliminary Development Plan.
- Excess MHTC property will be conveyed to the City and become property of QuikTrip, per executed agreement between the City and MHTC and subject MOU. The MOU between the City and QuikTrip will ensure continued public use of existing Blue Parkway until relocated Blue Parkway is constructed. The MOU further describes the conveyance of right-of-way by QuikTrip to the City and City licensed use of right-of-way by QuikTrip for private encroachments and continued use until the QuikTrip has vacated the encroachment. The timing of these transactions is described in the MOU.
- Upon right-of-way clearance, final plans for the project can be submitted and project let for construction. The City is administering the project until final plan approval, including all plan preparations and property acquisitions. MoDOT is administering letting and construction.
