The applicant has submitted an appeal to the list of prohibited uses for the City Council to consider certain “prohibited” uses as permitted uses as part of a future redevelopment plan for the former Calmar site consisting of approximately 24.5 acres at the southeast corner of the US 50 Hwy/South M-291 Hwy intersection that makes up the LS Arts & Entertainment sub-area. More specifically, the applicant’s appeal is for the following uses that fall under the class of prohibited uses (UDO Section 5.650.E) for the EnVision LS area: 1) automotive/truck related uses; 2) retail-big box in excess of 80,000 sq. ft. on one level; 3) car wash-indoor, outdoor or automated; and 4) day care-except as an accessory use within a larger building for a permitted use.
The applicant submitted an appeal to the list of prohibited uses in 2023 to pursue the same four (4) aforementioned “prohibited” uses, but specifically for the southwest corner of the US 50 Hwy/South M-291 Hwy intersection (the LS Mixed Uses sub-area) in preparation for the Oldham Village redevelopment plan for the former Adessa Auto Auction site. The City Council approved the appeal request on December 19, 2023, and subsequently approved the Oldham Village redevelopment plan on January 14, 2025.

Proposed City Council Motion:
I move to approve the appeal to allow consideration of the following “prohibited” uses under a future preliminary development plan for the LS Arts & Entertainment sub-area: automotive/truck related uses; retail-big box in excess of 80,000 sq. ft. on one level; car wash-indoor, outdoor or automated; and day care.
