Issue/Request:

The applicant requests that the City vacate a utility easement in association with the development of the previously approved elementary school.  More specifically, the requested easement to be vacated with this application is a 30-ft. wide sanitary sewer easement generally running east-west.  Redevelopment of the subject site will include the abandonment and realignment of existing sanitary sewer line that renders the subject easement as unneeded and therefore will no longer serve a public purpose.  A new sanitary sewer easement to serve the development of the site has been dedicated via the Summit Village Corporate Park, 2nd Plat.

I move to recommend approval of Application #PL2026-175 - VACATION OF EASEMENT - 915 NW Colbern Rd; Kaw Valley Engineering, Inc., applicant.

Recommendation

Recommendation: Based on staff’s review and finding that the application meets the applicable requirements of the UDO and the Design & Construction Manual, staff supports the proposed application, subject to the conditions of approval outlined below.

1.                     The vacation of the easement shall not become effective until such time as the existing public utility lines contained therein are abandoned and/or removed.

2.   The vacation of the easement shall not become effective until such time as the City accepts the realigned sanitary sewer line replacing the existing sanitary sewer line contained therein.
