Issue/Request:

The applicant requests to vacate a 10-ft. wide utility easement running adjacent to the west and south property lines. The partial vacation is being sought to allow for the construction of a swimming pool and associated decking to serve the single-family house that is under construction.

Recommendation

Recommendation: Based on staff’s review and finding that the application meets the applicable requirements of the UDO and the Design & Construction Manual, staff supports the proposed application, subject to the conditions of approval outlined below.

1.                     The vacation of easement shall be recorded at Jackson County prior to the issuance of a building permit for the proposed pool.
