Issue/Request:

This is a public hearing to consider the Petition for Removal of Real Property from the 291 South Regional Community Improvement District (CID) (the “Removal Petition”).

 

Key Issues:

Evaluation of whether property should be removed from the CID area.

 

Background:

On January 14, 2025, the City Council approved the 291 South Regional Community Improvement District (the “CID” or “District”) through the adoption of Ordinance No. 10052.  In February 2025, a lawsuit was filed against the City in the case Hy-Vee, Inc. vs. Oldham Village Community Improvement District and City of Lee’s Summit, Missouri, Case No. 2516-CV08649.  (properly named the 291 South Regional Community Improvement District.) The City has agreed to process a Petition for removal of the Hy-Vee property from the CID boundaries.

 

The Petition for Removal of Property was considered by the CID. The CID passed Resolution No. 2025-11 on November 13, 2025, by which the CID consented to the removal of this property from the CID area.  The CID has found that removal of the property will not impair any District obligations, in that the District found that it can meet its obligations without the revenues anticipated to be generated by the property that is proposed to be removed.

 

Impact/Analysis:

If this petition is approved, it would remove the property as indicated in the Petition from the boundaries of the CID.

 

Timeline:

The removal would take effect upon passage of the ordinance.
