Issue/Request:

On November 18, 2025, the City Council reviewed a preliminary development plan (PDP) for Pathways at Kensington Farms, a proposed 540-unit residential project on approximately 13 acres at 1231 SW Waterloo Drive. The development included three phases with a mix of detached single-family homes, attached units, and senior villas, as well as a land swap to accommodate a future park and school site. After the public hearing, the City Council denied the PDP.

 

Following the denial, the applicant asked staff about submitting a revised PDP focused solely on Phase I. Under UDO Section 2.340, new PDP applications cannot be accepted within 60 days if they involve “substantially the same property.” The Development Services Director determined the revised Phase I submittal would still involve substantially the same property, so the 60-day restriction applies.

 

On December 4, 2025, the applicant appealed this determination, asking the City Council to waive the 60-day waiting period so they could immediately submit a new PDP for Phase I only. The appeal does not require a public hearing or notice.

 

If the City Council approves the appeal:

The rest of the 60-day period is waived, and the applicant may immediately file a new Phase I PDP, which must fully comply with all UDO procedural and substantive requirements (e.g., neighborhood meeting, public notice, hearings).

 

If the City Council denies the appeal:

The applicant must wait until the 60-day period expires before submitting any new PDP version, which would also have to meet all standard UDO requirements.
