Issue/Request:

Heartland Market is a proposed convenience store with fuel sales at 940 NE Colbern Road.  The Preliminary Development Plan (PL2022-327) was approved by City Council on March 16, 2023.  The applicant then submitted the Final Development Plan which was approved by staff on June 24, 2023.

 

Per Section 2.380 of the Unified Development Ordinance, final development plan approval is valid for 12 months, however, the Governing Body my grant one extension of 12 months upon written request of the original applicant.  Due to needing more time for permitting, the applicant requested an extension of the final development plan approval prior to the approval expiring on June 24, 2024.

 

There are no proposed changes to the approved final development plan with this extension request and all conditions of the zoning and preliminary development plan are still applicable. 

 

Staff finds the request to be reasonable and supports the 12-month extension.

 

 

Proposed City Council Motion:

I move to approve the extension request for Application #PL2023-055 - Final Development Plan Extension Request - Heartland Market - Lee’s Summit, 940 NE Colbern Road.; The Great American Dream IV, LLC, applicant.
