Issue/Request:
The applicant proposes to vacate the subject right-of-way in association with the development of the new Hazel Grove Elementary School. The subject property is a strip of right-of-way that will be replaced with an access easement to provide access to the future City park to the east. No objection to the proposed vacation of right-of-way has been raised by any private utility, the City’s Public Works or Water Utilities Departments.

Recommendation
Recommendation: Based on staff’s review and finding that the application meets the applicable requirements of the UDO and the Design & Construction Manual, staff supports the proposed application, subject to the conditions of approval outlined below.
1. The vacation of the right-of-way shall not become effective until such time an access and utility easement is recorded and accepted by the City.
