Discussion regarding the Noise Ordinance

Issue/Request:
During the course of the public hearings held before the Planning Commission and City Council in July and August of this year for the proposed McBee’s Coffee N Carwash (Appl. #PL2022-178), an area resident raised concerns that the proposed car wash would not be in compliance with the City’s noise ordinance. Upon further investigation by staff of the concerns raised by the resident, staff determined that the resident's concerns were borne from the resident's misinterpretation of the existing noise ordinance. However, the discussion did spur questions and a desire for clarification on the application and enforcement of acceptable sound levels established under the City's Noise Ordinance.
Provided below as reference for discussion is the table from the noise ordinance (Sec 17-256 - Sound levels by receiving land use) that outlines the acceptable sound levels for the various types of land uses throughout the city. Please note that compliance with the sound level limits outlined below is determined when measured at the property boundary of the land use receiving the sound, not when measured from where the sound originates.
