Title

Public Hearing:  Galaxy Liquor - Liquor license application appeal hearing.

Body

Issue/Request:

The City Council will conduct an appeal hearing regarding the denial of a liquor license application submitted by Galaxy Operations, LLC, doing business as Galaxy Liquor, for the premises located at 150 NE Tudor, Lee's Summit, MO. This appeal, initiated by the applicant following the Director of Liquor Control's decision, is scheduled to allow the applicant to present their case to the City Council. The denial stems from the application's proximity to a church, a factor regulated by City Code Section 4-13, which specifies that it is unlawful to grant a license for the sale of alcoholic beverages within one hundred (100) feet of any school, church, or other building regularly used as a place of religious worship. For premises located between one hundred (100) and three hundred (300) feet of such a religious building, the Council is required to hold a public hearing before making a decision. The distance measurement is determined from the closest point of the premises to the closest point of the school, church, or other religious building.
