Title

An Ordinance vacating a portion of a certain easement located at 201 SW Oldham Parkway in the City of Lee's Summit, Missouri

Issue/Request:

The applicant proposes to vacate an approximately 20'-wide x 531'-wide portion of a 20’ utility easement along the south boundary of Lot 2 of Oldham Village, 1st Plat.  The subject easement conflicts with the location of a retaining wall and a trash enclosure associated with the future Lee’s Summit Indoor Sports Complex (previously referred to as the Lee’s Summit Parks Fieldhouse).  The City’s Encroachment Policy prohibits certain structures, such as retaining walls and trash enclosures, from being located within the boundaries of a public utility easement.  The subject portion of easement does not serve a public purpose.  No objection to the proposed vacation of easement has been raised by any private utility, the City’s Public Works or Water Utilities Departments.

 

Proposed City Council Motion:

I move for a second reading of An Ordinance vacating a portion of a certain easement located at 201 SW Oldham Parkway in the City of Lee's Summit, Missouri.

Recommendation

With the conditions of approval contained in the staff report, the application meets the requirements of the UDO and Design and Construction Manual (DCM).
