Issue/Request:
An Ordinance approving Change Order No. 1 to the On-Call Agreement 2024-057/2R for the construction of SE 5th St Storm Repair - WO131527 with Wiedenmann, Inc. for an increase in the contract price of $128,677.99, for a revised agreement amount of $469,928.99 and authorizing the City Manager to execute an agreement for the same.
Key Issues:
• Pursuant to Ordinance No. 9567, Under the Procurement Policy 6.1 Cooperative Purchasing - the City can "piggyback" on public agency contracts when allowed by the contract to receive the same lowest and best bid pricing.
• Through the LS Bid #2024-057 R2, the City and Wiedenmann, Inc entered into a contract for Wastewater Sewer System Infrastructure Repairs to remove and replace failed corrugated metal pipe (CMP) at SE 5th St between SE Onyx Dr and SE Topaz Dr.
• In accordance with Section 4.3 of the Agreement, Wiedenmann submitted an estimated cost of $341,251.00 to perform the work.
• This is the final change order to close the project and cover the cost of the additional work necessary to complete the project.

Background:
The Public Works Department is responsible for the maintenance of more than 110 miles of Corrugated Metal Pipe (CMP). Much of the CMP was installed throughout the City in the 1970’s up to the early 2000 timeframe. With a combination of standard runoff contributing to CMP systems and the acidic soils present in Lee’s Summit, the bottom portion of these pipes will rust through and ultimately fail. The failure of the system creates dangerous conditions and poses a safety risk to the public. The City no longer allows CMP in the construction of public infrastructure.
The Public Works Department became aware of the failing 54-inch diameter CMPs at the tributary crossing at SE 5th Street between SE Onyx Drive and SE Topaz Drive during the summer of 2024. The four parallel sections of CMP were installed in 1988 had an expected lifespan of 35 years. Public Works Engineering provided the design and construction documents for the project. Public Works Operations reached out to Wiedenmann and received a quote to remove and replace the storm lines. The completed project includes installation of Reinforced Concrete Pipe (RCP). RCP has an expected lifespan of 100 or more years.
The condition of the pipe was such that the bottom of 2 of the four pipes were completely rusted out. The two other pipes were missing over 50% of the bottom of pipe. This condition would very likely create a sinkhole, and require closing the road, in the near future. The design was expedited to ensure the replacement pipes would carry the same volume of water, or more, under the roadway and not have to realign the road. The job order contract method was selected to expedite construction. As such, Public Works made the conscious decision to accept the risk that the water main could be in the way and field adjustments were likely to occur during construction in order to save time and prevent more extensive damage to the roadway.
As expected, the Contractor had to make changes in the field. These changes included relocation of an 8” water main, tree removal, driveway reconstruction, additional creek grading, additional concrete at the Headwalls/Aprons, addition of a handrail, and bypass pumping due to a very wet construction season.
Wiedenmann completed the project on schedule. The change order and total cost remains within available budget. The Public Works Department received compliments from a local citizen commending the contractor for the cleanliness of the site at the end of each day and that the finished product looks great. Attached are some before and after pictures of the site.
Impact/Analysis:
All work is complete and the road has been re-opened to traffic.
