Issue/Request:
An Ordinance approving Modification No. 3 to an Agreement for Professional Engineering Services for the Olive and Orchard Street and Storm Sewer Improvements (Douglas Street to Chipman Road)(RFQ No. 2022-060), between the City of Lee's Summit, Missouri, and Kimley-Horn, for an increase of $85,460.00 with an amended amount of $1,071,893.50 and authorizing the City Manager to execute an agreement for the same.
Key Issues:
• The City and Kimley-Horn and Associates, (hereinafter "Engineer") entered into an Agreement for Professional Engineering Services for the Olive and Orchard Street and Storm Sewer Improvements (Douglas Street to Chipman Road) Project (RFQ No. 2022-060) dated November 21, 2022 (hereinafter "Base Agreement").
• The City and Engineer modified the Base Agreement pursuant to Modifications No. 1 and No. 2 dated November 30, 2023 and January 10, 2024, respectively, for additional design and survey for storm water infrastructure.
• City staff has determined the necessity to incorporate construction and engineering administration support services (hereinafter “Services”).
• Engineer has submitted a proposal with estimated costs to provide the Services.
• The City desires to further modify the Base Agreement, as amended, with Engineer for the Services (hereinafter “Modification No. 3”).

I move to recommend to the City Council approval of an Ordinance approving Modification No. 3 to an Agreement for Professional Engineering Services for the Olive and Orchard Street and Storm Sewer Improvements (Douglas Street to Chipman Road)(RFQ No. 2022-060), between the City of Lee's Summit, Missouri, and Kimley-Horn, for an increase of $85,460.00 with an amended amount of $1,071,893.50 and authorizing the City Manager to execute an agreement for the same.

FIRST MOTION: I move for a second reading of an Ordinance approving Modification No. 3 to an Agreement for Professional Engineering Services for the Olive and Orchard Street and Storm Sewer Improvements (Douglas Street to Chipman Road)(RFQ No. 2022-060), between the City of Lee's Summit, Missouri, and Kimley-Horn, for an increase of $85,460.00 with an amended amount of $1,071,893.50 and authorizing the City Manager to execute an agreement for the same.
SECOND MOTION: I move for adoption of an Ordinance approving Modification No. 3 to an Agreement for Professional Engineering Services for the Olive and Orchard Street and Storm Sewer Improvements (Douglas Street to Chipman Road)(RFQ No. 2022-060), between the City of Lee's Summit, Missouri, and Kimley-Horn, for an increase of $85,460.00 with an amended amount of $1,071,893.50 and authorizing the City Manager to execute an agreement for the same.
Background:
The City and Kimley-Horn entered into an Agreement dated November 21, 2022, (RFQ No. 2020-060) for Professional Engineering Services for the Olive and Orchard Street and Storm Sewer Improvements project. To date, the Base Agreement has been modified twice to cover design and survey for storm water infrastructure.
The City advertised and awarded the construction of the Olive and Orchard project to VF Anderson. With that construction contract, the contractor will be required to submit shop drawings and material certifications that must be reviewed by Kimley-Horn to ensure conformance with project plans and specifications. Kimley-Horn will also need to attend periodic construction meetings, respond to contractor’s Requests for Information, and prepare post-construction record drawings.
This project is delivered using a traditional design, bid, build (DBB) approach, as the best and most efficient method. The designer was selected based on qualifications (RFQ) in accordance with law. The project was competitively bid. An amendment to the design services agreement is necessary for construction services and support.
Impact/Analysis:
This agreement will allow Kimley-Horn to provide the City with construction and engineering related administrative services identified in the attached scope (Exhibit 1).
