Issue/Request:
An Ordinance authorizing execution of a Contract in accordance with the City's On-Call Contract for Repair Services for Water, Wastewater, and Stormwater Infrastructure (Contract 2019-003/1R) with Wiedenmann, Inc. for installation of NE Maybrook Drainage Improvements for a not to exceed cost of $157,358.00, and authorizing the City Manager to execute an agreement of the same for the City of Lee's Summit, Missouri.
Key Issues:
• The City Council approved an On-Call contract (Contract 2019-003/1R) with Wiedenmann, Inc. for the repair of Stormwater Infrastructure that set time and material rates for such work.
• Stormwater improvements to protect public infrastructure were approved as part of the 2017 CIP Sales Tax renewal approved by voters
• 5261 NE Maybrook Road has long been a problem area for standing water within the roadway, and undermining pavement.
• The City has coordinated with adjacent private development to acquire easements and complete engineering design for mutual benefits in addressing the stormwater issues in the project area.

FIRST MOTION: I move for a second reading of an Ordinance authorizing execution of a Contract in accordance with the City's On-Call Contract for Repair Services for Water, Wastewater, and Stormwater Infrastructure (Contract 2019-003/1R) with Wiedenmann, Inc. for installation of NE Maybrook Drainage Improvements for a not to exceed cost of $157,358.00, and authorizing the City Manager to enter into an agreement for the same.
SECOND MOTION: I move for adoption of an Ordinance authorizing execution of a Contract in accordance with the City's On-Call Contract for Repair Services for Water, Wastewater, and Stormwater Infrastructure (Contract 2019-003/1R) with Wiedenmann, Inc. for installation of NE Maybrook Drainage Improvements for a not to exceed cost of $157,358.00, and authorizing the City Manager to enter into an agreement for the same.
Background:
Stormwater at the corner of 5261 NE Maybrook Road has flowed over Maybrook Road for many years. Standing water on the roadway pavement has been the norm after rains. This standing water saturates the soil under the roadway, undermining the road, and thus increasing the costs to repeatedly repair the area. There was no funding for this type of work before the 2017 CIP Sales Tax renewal, which included funding for stormwater work to address impacts on public roadways. Also, when the City had previously approached property owners for the necessary easements to install the stormwater infrastructure, they were not willing to cooperate directly with the City.
In 2018, a property owner initiated proposed improvements on their property through the Development Services department. The standard design and construction requirements would have required a significant amount of stormwater improvements, utility relocations, and other work that (a) would not have addressed the current flooding issues on Maybrook Road, and (b) provided very little, if any, stormwater benefits for both public and private entities. As part of the engineering review and analysis, the City and the developer identified alternatives that would address the inundation of Maybrook Road and manage the stormwater issues related to the proposed development. In lieu of constructing the standard stormwater improvements, the developer agreed to design improvements for Maybrook Road and acquire the necessary easements. The City would install the improvements before the site work is complete. That engineering and easement acquisition work has been completed. In order to meet the timelines on this projects, and the relatively small scope, it is recommended to use the existing on-call services.
Impact/Analysis:
Construction of the stormwater system will alleviate road flooding, improve safety, protect public infrastructure in the area, and manage the stormwater issues related to the adjacent project.
