Issue/Request:
An Ordinance approving and authorizing the execution of an amendment to the Agreement between the City of Lee's Summit, Missouri and Titan Built, LLC to set Guaranteed Maximum Price 2 (GMP 2) for Joint Operations Facility and Police/Courts Phase 2 Renovations Project in the amount of $7,077,827.00, and authorizing the City Manager to execute the same.
Key Issues:
• Pursuant to Ordinance No. 9898 approved on April 23, 2024, the City entered into a preconstruction services agreement (Agreement) with Titan Built, LLC for the amount of $87,825.00 for certain preconstruction services and to establish a guaranteed maximum price (“GMP”) to construct the Joint Operations Facility and Phase 2 Police/Courts Renovations.
• City Council approved an amendment for GMP 1, addressing long-lead items for the Police/Courts Phase 2 Renovations Project work in September of 2024.
• For GMP 2, addressing site, foundation, and structural work for the Joint Operations Facility and Police/Courts Phase 2 Renovations Project, Titan Built LLC received 44 bids and will award 10 subcontracts.
• City staff supports amending the current Agreement with Titan Built for GMP 2 in the amount of $7,077,827.00.

SECOND MOTION: I move for approval of an Ordinance approving and authorizing the execution of an amendment to the Agreement between the City of Lee's Summit, Missouri and Titan Built, LLC to set Guaranteed Maximum Price 2 (GMP 2) for Joint Operations Facility and Police/Courts Phase 2 Renovations Project in the amount of $7,077,827.00, and authorizing the City Manager to execute the same.
Background:
In 2023, voters approved a No Tax Increase Bond for public safety and emergency preparedness projects, including the Joint Operations Facility and Phase 2 Police/Courts Renovations.
On December 19, 2023, the City Council passed Ordinance No. 9886 recommending approval of a contract between the City and Hoefer Welker for the architectural work associated with the Joint Operations Facility and Phase 2 Police/Courts Renovations.
In November 2023, the City issued RFQ 2024-043 for Pre-Construction Services and Construction Manager at Risk to identify qualified companies which could construct the projects as a Construction Manager at Risk. Eight firms responded to the RFQ. A selection committee comprised of representatives from the City, Police Department, and Fire Department held interviews with selected firms in December 2023. Titan Built, LLC was selected as the most qualified respondent. On April 23, 2024 the City Council approved Ordinance No. 9898, which authorized the City to enter into a Pre-Construction Agreement with Titan Built, LLC.
On September 24, 2024 the City Council approved Ordinance No. 24-150, which authorized an amendment for GMP 1.
Impact/Analysis:
GMP 2 will allow the Construction Manager to perform site, foundation, and structural work for the Joint Operations Facility and Police/Courts Phase 2 Renovations Project.

Start: August 2024
Completion: March 2026
Other Information/Unique Characteristics:
This agreement will also be amended with Guaranteed Maximum Price 3 (GMP 3) for remaining construction of the Joint Operations Facility and Police/Court Phase 2 Renovations.
