Issue/Request:

An Ordinance approving Change Order No. 4 to the agreement for the McClendon Ditch Sewer Improvements Project, Project No. 425, between the City of Lee's Summit, Missouri and Infrastructure Solutions, LLC., to increase the project timeline by 103 calendar days, and authorizing the City Manager to execute an agreement for the same.

 

 

Key Issues:

                     Pursuant to Ordinance No. 9556, the City and Infrastructure Solutions, LLC. (hereinafter "Contractor") entered into an agreement for the construction of the McClendon Ditch Sewer Improvements Project, Project No. 425 (hereinafter "Base Agreement").

 

                     The City and Contractor modified the Base Agreement, as amended, per Change Order No. 1 administratively in accordance with the City's Procurement Policy.

 

                     Pursuant to Ordinance No. 9840, the City and Contractor further modified the Base Agreement, as amended, per Change Order No. 2 for an adjustment in construction time for additional rock excavation and a change in the boring method to complete the work.

 

                     The City and Contractor modified the Base Agreement, as amended, per Change Order No. 3 administratively in accordance with the City's Procurement Policy.

 

                     The City desires to further modify the Base Agreement, as amended, to adjust construction contract time to allow for the impeded progress throughout the project due to the amount and type of rock encountered, extending the amount of time to complete the work.

FIRST MOTION: I move for second reading of an Ordinance approving Change Order No. 4 to the agreement for the McClendon Ditch Sewer Improvements Project, Project No. 425, between the City of Lee's Summit, Missouri and Infrastructure Solutions, LLC., to increase the project timeline by 103 calendar days, and authorizing the City Manager to execute an agreement for the same.

 

 

 

SECOND MOTION: I move for adoption of an Ordinance approving Change Order No. 4 to the agreement for the McClendon Ditch Sewer Improvements Project, Project No. 425, between the City of Lee's Summit, Missouri and Infrastructure Solutions, LLC., to increase the project timeline by 103 calendar days, and authorizing the City Manager to execute an agreement for the same.

 

 

 

Background:

The sanitary sewer mains, from Executive Way & Blue Parkway to Pryor Rd & Rock Island Trail, were identified as undersized and hydraulically impaired.   These lines support existing customers and future growth from the west side of the Downtown to Longview Road.  Sanitary Sewer studies, including the 2022 Wastewater Master Plan, recommend the replacement and upsizing of this interceptor sewer main to relieve existing system surcharging and support increased density of use as identified in the Comprehensive Plan.

 

Change Order No. 1 was approved administratively to take care of additional rock excavation, additional cost for bypass pumping due to the excavation taking significantly longer than anticipated, as well as two additional sanitary sewer reconnections that were inadvertently left off of the original bid quantities.

 

Change Order No. 2 was approved by City Council to add an additional 85 calendar days and $127,238.20 to the project.  Due to varying site conditions, rock excavation quantities were in excess of the original estimate.  Additionally, boring methods to install sewer casing were modified to adjust for the varying site conditions. Both rock excavation and the change in boring method required additional time and money to complete.

 

Change Order No. 3 was approved administratively due to a decrease in concrete driveway quantities, asphalt driveway quantities, asphalt street pavement, additional by-pass pumping, over excavation and rip rap installation, and an extension of calendar days to complete the work.

 

This change, Change Order No. 4, will address adding an additional 103 calendar days to the project. Throughout the length of the project the contractor has encountered more rock than was originally anticipated. Also, the type of rock was significantly harder than was anticipated and these items have resulted in a slower rate of progress. The Contractor submitted a request for additional days based on what was encountered during construction. City staff and the City's consultant engineer evaluated the request and recommended the additional days with the understanding that there is no additional cost added to the City.

 

 

 

Impact/Analysis:

Improving the Downtown Trunk Line (McClendon Ditch Sewer) will reduce I&I and increase capacity for densification of the downtown basin served by the interceptor.
