Title

An Ordinance creating Article 6 in Chapter 26 of the City Code to provide for the delegation of authority to City Staff for the management, operations, security, maintenance and upkeep of Green Street.

 

Body

Issue/Request:

This Ordinance would create a new Article 6 in Chapter 26 of the City Code, to provide for the delegation of authority to the City Manager and his or her designees to allow for the management, operations, security, maintenance and upkeep of the public facilities in the Green Street project.

 

Key Issues:

Delegation of authority to the City Manager and his or her designees for the purposes states above.

 

Proposed City Council Motion:

I move for second reading of An Ordinance Creating Article 6 in Chapter 26 of the City Code to provide for Delegation of Authority to City Staff for Management, Operations, Security, Maintenance and Upkeep of Green Street.

 

Background:

The Green Street project is opened and operating. This document would create a new Article 6 in Chapter 26 of the City Code to provide for the delegation of authority from the City Council to the City Manager and other City staff to provide for the negotiation and execution of service agreements, rental agreements, service contracts and other types of agreements to provide for the regular operation, management, maintenance, security and upkeep of Green Street facilities. 

 

Impact/Analysis:

New Section 26-602 would provide for the delegation of authority in these areas:

 

A.                     Negotiaton and execution of contracts and agreements for management and operations.

B.                     Negotiaton and execution of contracts and agreements for maintenance, upkeep, cleanliness and security.

C.                     Rental agreements that do not exceed seven calendar days.

D.                     Negotiaton and execution of sponsorship agreements, advertising agreements, and any agreement relating to the procuremet of advertisements, sponsorships and donations of money or property for Green Street.

E.                     Negotiation and execution of contracts related to public and public-private programming which involve the use of public facilities in Green Street.

F.                     The City Manager may adopt written guidelines for implementation.

G.                     The Council is not delegating its fundamental rulemaking authority for Green Street.

H.                     The City Manager may further delegate authority to City staff to exercise this delegated authority.

 

This Article also contains standards to guide the exercise of the delegated authority.  All rental agreements and advertising agreements my be commercially reasonable and at fair market values.  Section Section 26-603.D grants authority to the City Manager to adopt Green Street Rental Fees and update the fees from time to time, with at least two weeks prior notice before the new rental fees would take effect.

 

Timeline:

This ordinance would take effect upon approval and City staff would immediately rely on this authority for operations, maintenance, upkeep, security, and other matters discussed above.

 

Other Information/Unique Characteristics:

Green Street is a unique City facility and is therefore the subject of this specific set of City Code provisions.
