Issue/Request:

An Ordinance awarding the bid for Project No. 106 for the Douglas Complete Street Improvements from SE 2nd Street to NE Chipman Road Project to Pyramid Contractors Inc. for an amount of $6,994,890.00 and authorizing the City Manager to execute an agreement for the same, all as an Emergency Ordinance pursuant to Sections 3.13 (f)(1) and (3) of the Charter for the City of Lee's Summit, Missouri.

 

Key Issues:

                     Public Works Engineering issued an advertisement for bids for the construction of Project No. 106 - Douglas Complete Street Improvements ("Project") on May 5, 2026, in accordance with state and federal statutes and local policies.

 

                     The project will enhance roadway, cyclist, and pedestrian safety, improve and/or replace stormwater and drinking water lines and update sanitary sewer facilities.

 

                     The project will be funded from the 2017 CIP Sales Tax Renewal, Water Utilities construction funds, and obligated Federal TAP funds.

 

                     Construction start time is critical on this project; with coordinated completion of Phase 1 at the intersection of 2nd and Douglas desired before the holiday shopping season begins downtown.

 

                     Pyramid Contractors Inc. ("Contractor") was determined to be the lowest responsive and responsible bidder by City staff.

 

                     The City and Contractor desire to enter into an agreement to construct the Project. 

 

                     This ordinance is necessary as an emergency ordinance to enable the completion of Construction Phase 1, the intersection of Douglas and 2nd Street, before the downtown retail shopping season begins, and winter weather could cause extended construction delays impacting access to the downtown area; This emergency clause is allowed under Section 3.13 (f)(1) and (3) of the Charter.

 

Proposed City Council Motion:

FIRST MOTION: I move for second reading of an Ordinance awarding the bid for Project No. 106 for the Douglas Complete Street Improvements from SE 2nd Street to NE Chipman Road Project to Pyramid Contractors Inc. for an amount of $6,994,890.00 and authorizing the City Manager to execute an agreement for the same, all as an Emergency Ordinance pursuant to Sections 3.13 (f)(1) and (3) of the Charter for the City of Lee's Summit, Missouri.

 

SECOND MOTION: I move for adoption of an Ordinance awarding the bid for Project No. 106 for the Douglas Complete Street Improvements from SE 2nd Street to NE Chipman Road Project to Pyramid Contractors Inc. for an amount of $6,994,890.00 and authorizing the City Manager to execute an agreement for the same, all as an Emergency Ordinance pursuant to Sections 3.13 (f)(1) and (3) of the Charter for the City of Lee's Summit, Missouri.

 

 

Background:

The Project will reconstruct existing Douglas Street between SE 2nd Street and NE Chipman Road to complete street standards in alignment with the Livable Streets Policy. This work includes a 10-foot shared-use path, a 5-foot sidewalk, curb and gutter, continuous lighting and tree plantings. Additional project improvements include drinking water main upgrades, new stormwater infrastructure, City fiber installation, and minor sanitary sewer improvements. The Project was identified in the Greenway Master Plan and Thoroughfare Master Plan and will be funded from a combination of funds and programs. The 2017 CIP Sales Tax allocated fund, the Water Utilities water and sewer construction funds and Federal TAP funds.

 

Construction Phase 1 will partially close the intersection of 2nd and Douglas Streets. Lane closures will restrict turning movements and directional travel during construction, thus significantly impacting access to the Downtown Lee’s Summit commercial district. Phase 1 is limited to 90 calendar days. Delaying contract approval will extend the work beyond Thanksgiving and increase risk of extended construction work zones impacting the intersection through the winter.

 

Originally, the bids were scheduled to be opened on June 2nd, and the go to the June 8th Public Works Committee. It would then have gone to Council on June 16th. However, a bid addendum had to be issued that incorporated changes to the Phase 1 of construction which allowed the intersection to remain open, with restrictions, during construction instead of a full closure as originally proposed by the Engineer. This bid Addendum forced the bid opening to be delayed one week to allow potential bidders time to review and evaluate these changes in the bid documents. Avoiding a full closure was directed by Staff in consideration of minimizing public impacts, school transportation disruptions, and downtown traffic accessibility.

Impact/Analysis:

By delaying the bid opening to June 9th, the next PWC meeting would be July 14th. That would delay final contract approval to July 21st. Approving the contract on June 16th will allow a notice to proceed to be issued no later than August 17th. Adding 90 days results in completing Phase 1 not later than November 16th. If the contract approval is delayed to July 21st, the likely Notice to Proceed with construction would have been September 21st, thus resulting in a Phase 1 completion date of December 20th. This is the rare case where a one-week delay could add several months to construction due winter weather.

 

Public Works Engineering advertised for bids for the construction of Project No. 106 on May 5, 2026. Potential bidders were notified through QuestCDN, on the City’s and MoDOT’s websites, and two local newspapers. There were Thirteen (13) plan holders, Four (4) responsive bids were received by the June 8, 2026, bid opening date. The lowest and most responsive bid received was from Pyramid Contractors Inc That bid is approximately 83% of the engineer's estimate and within budget.  This project is delivered using a traditional design, bid, build process.

Recommendation

City staff is recommending to proceed with awarding this construction contract. Construction is anticipated to begin August of 2026 with 390 days to achieve substantial completion, which is (on or about September 10, 2027 (subject to weather, unforeseen utility conflicts, etc.).
